Subject: SB 6 - Firearm Regulation
 
IMMEDIATE ACTION NEEDED: NEW MUNICIPAL PREEMPTION BILL
  
Following the defeat of HB 2322 yesterday on the Senate floor, a new Floor Amendment has been filed for  SB 6 in the House making it an omnibus firearm bill including new municipal preemption language .  This bill can be voted on this afternoon in the House.
 
Of the eleven (11) new sections in the bill, Section 8 amends 21 O.S. Section 1289.24 by expanding state preemption. In current law, subsection (A)(3)'s preemption language covers the otherwise lawful "open" carrying of a "handgun" under the provisions of the Oklahoma Self-Defense Act. The proposed amendment reads: the otherwise lawful carrying of a "firearm" under the provisions of the Oklahoma Self-Defense Act "or the Oklahoma Firearms Act of 1971".     
 
The new proposed amendment also makes changes to current law in:
 
  • Unlawful Carry                                                                                    
  • Improper Transportation of Firearms
  • Unlawful Carry in Certain Places                                                       
  • Concealed Firearm for Off-Duty Police Officer
  • Convicted Felons and Delinquents                                                    
  • Short Title
  • Conditions Under Which Firearms May Be Carried                           
  • Authority to Issue License
  • Firearms in Vehicles
  • Business Owner's Rights
