OSHA Files for Re-Hearing of 
PSM Decision

Last week, OSHA filed a petition for rehearing of the Process Safety Management (PSM) decision from September, which reinstated the retail exemption from the PSM standard for ag retailers.  The petition argues that the DC Circuit improperly interpreted the July 2015 guidance as a standard subject to notice and comment rulemaking, rather than as an interpretative rule, not subject to notice and comment.  In so doing, OSHA is ignoring the DC Circuit's clear understanding between what constitutes a standard versus an interpretive rule.  The OSHA petition asks for either the three judge panel, which ruled unanimously against the agency, to reconsider their decision, or for the entire DC Circuit Court to review the decision. 
 
The likelihood of the DC Circuit doing either of these reconsiderations is very low.  Assuming the DC Circuit declines, OSHA will then have the opportunity to file a petition with the Supreme Court in an attempt to overturn the DC Circuit decision.  The Supreme Court is very picky about these types of federal rulemaking challenges and will only likely consider reviewing it if they believe it to be sufficiently precedent setting.  The bar here is very high indeed. 
FDA Updates List of Licensed Medicated Feed Mills and VFD Distributors
FDA has released an updated list of licensed medicated feed mills and Veterinary Feed Directive (VFD) distributors.  An approved medicated feed mill license is required for facilities that manufacture feed using Category II, Type A medicated articles or manufacture certain liquid and free-choice feed, using Category I, Type A medicated articles that must follow proprietary formulas or specifications.  Click HERE for a current list of licensed medicated feed mills.  A VFD drug is intended for use in animal feeds, and such use of the VFD drug is permitted only under the professional supervision of a licensed veterinarian.  Click HERE for updated VFD Distributor Notifications from FDA.

Asmark Institute is offering the LifeCycle Tank Management Program under its Compass Line of Services.  Experience has shown that there are several use factors that determine how long a tank will last.  LifeCycle is a tank management program designed to provide a practical approach to managing the useful life of tanks with capacities from 750 to 99,000 gallons.  The service also covers both stationary and mobile tanks.  Click HERE for more information on the program.
