Anesthesia Associates of Massachusetts ("AAM") is suing Plexus Anesthesia Services of Massachusetts ("PASM") and its affiliate, Plexus Management Group ("PMG"), for allegedly failing to pay it approximately $2.3 million that it is owed. According to the complaint, AAM contracted with PASM to provide various anesthesia services for PASM at certain medical facilities. AAM also contracted with PMG for PMG to manage AAM's accounts receivable and collect payments due to AAM for services rendered, including receivables due to AAM from PASM. AAM alleges that PASM is now insolvent and that PMG and PASM have favored making payments from PASM to PGM and to one of AAM's competitors who services PASM's largest account over making payments to AAM. In addition to breach of contract, AAM alleges that defendants' violated GL c. 93A and that the payments to PASM constitute a fraudulent conveyance. Not very sedate.
