2018-19 Budget Update

What happened last week?

On May 16th, the Governor released the May Revision.  Last week, the two legislative budget subcommittees, Senate Subcommittee 1 on Education and the Assembly Subcommittee 2 on Education Finance reviewed the May Revision proposal/changes.  The Senate Subcommittee took final actions and votes on child care and early education issues to put forward as their recommendations.  Below are some of the highlights with all of the background and supporting information here.

Actions put forward:
  • Approved funding to reflect increased cost estimates for CalWORKs Stages 2 & 3
  • Approved funding to reflect a revised COLA from 2.51 to 2.71 percent
  • Approved funding for full-year costs of rate and slot increases
  • $8 million for an additional full-day Preschool slots beginning April 1, 2019
  • Funding to ensure that all no provider rates will go down from the enacted 2016 RMR survey.  Existing law had some provider rates in 57 of the 58 counties doing down effecting January 1, 2019.
  • An additional $287 million in ongoing non-Proposition 98 fir Child Care slots and rate adjustment factors over a two year period broken down:
    • $110 million for AP slots in 2018-2019 to increase to $215 million in 2019-2020 and future years
    • $72 million for ongoing to reflect an increase in adjustment factors for infants, toddlers, children with exceptional needs, and severely disabled children
    • The infant rate adjustment factor would be increased from 1.7 to 2.44 and the toddler rate adjustment factor from 1.4 to 1.8. In addition, the adjustment factor for children with exceptional needs would be increased from 1.2 to 1.54 and the adjustment factor for severely disabled children would be increased from 1.5 to 1.93
  • License-exempt child care providers receive roughly 30 percent of the licensed family child care hourly rate, while license-exempt child care providers receive 70 percent of the weekly and monthly rate.
  • Provide $15,955,000 in one-time federal child care quality carryover funds for quality-related purposes
  • Provide $10 million in one-time federal child care quality carryover funds for the Inclusive Early Care Support Pilot Program.
  • Federal CCDBG - Provide $236 million in federal Child Care and Development Block Grant (CCDBG) funding to be programmed pursuant to a plan developed by the Department of Education and approved by the Department of Finance. Funds shall not be expended sooner than 30 days after the plan is submitted to the Joint Legislative Budget Committee. Of this $25,481,000 shall be available for quality purposes, $100 million to increase compliance with federal requirements, $50 million to increase access in General Child Care, and the remaining $56,168,000 to increase access to Alternative Payment programs. To the extent the CDE determines less funds are needed for federal compliance, the CDE shall allocate the funds for increased access to General Child Care or the Alternative Payment Program. 
The Assembly Subcommittee is scheduled to vote and close our of Proposition 98 and child care this Wednesday at 1:30.

BELOW IS FROM MAY REVISION CHILD CARE
  • Cost-of-Living Adjustment
    The May Revision includes an increase of $2.2 million Proposition 98 General Fund and $1.8 million non-Proposition 98 General Fund to reflect a change in the cost-of-living factor from 2.51 percent at the Governor's Budget to 2.71 percent at the May Revision. 
  • Alternative Payment Program slots - 34,325 May Revision (increased from 32,775 (2017-18 budget)  to 33,096 January budget)
  • General Child Care slots - May Revision 28,427  slots (no change)  
    • Proposes an SRR increase for July 1, 2018 of 2.795%
  • Stage 2 - May Revision notes caseload of 58,674 an increase of 4,834 from January number of 53,840
    • No COLA
  • Stage 3 - May Revision notes caseload of 44,320 an increase of 8,231 January number of 36,089
    • No COLA
  • Migrant -May Revision continues COLA and July 1 SRR Increase
  • Hold Harmless - May Revision continues to restore funding so that no provider rates will be reduced 
  • Other Child Care Activities (R&Rs, LPCs, Child Care Initiative and Qualify Improvement) - May Revision notes $117,818 an increase in funding from January of  $17,207 .  This is due to federal quality funds and COLA.
  • CalWORKs Stage 1 child care - May Revision notes slight increase in enrollment to 38,843 from 38,760; The May Revision proposes Funding for Stage 1 Child Care at $326.8 million, a reduction of $36.8 million from the 2017-18 appropriation, but an increase of $675,000 above the January proposal. Specifically, the budget provides $5.2 million non-Proposition 98 GF to reflect slight increases in the number of CalWORKs child care cases and slight decreases in the estimated cost of care.
  • Pilot Program Funding - May Revision includes language to support CDE's pilot expansion bill (AB 2626 (Mullin)) 
  • Inclusive Early Education Expansion Program
    The Governor's January budget proposed an Inclusive Early Education Expansion Program, which anticipated a transfer of $42.2 million TANF funds. Those one-time federal dollars are no longer available, so the May Revision includes total funding of $167.2 million one-time Proposition 98 GF through a competitive grant program to increase the availability of inclusive early education and care for children aged 0 to 5 years old, especially in low-income
    areas and in areas with relatively low access to care. Grant recipients will commit that all children benefiting from grant funds, especially those with disabilities, have access to appropriate settings that support their educational and developmental growth. 
  • State Preschool Slots - This is the final allocation of 2,759 full-time slots for LEA's effective 2019
  • 3-Year Promise - This is the final year of a multi-year reinvestment promise from Governor Brown.
EMERGENCY FOSTER CHILD CARE BRIDGE -  The May Revision provides full-year funding beginning July 1, 2018 of $31 million for counties that opt into this program.

EDUCATION TRAILER BILL LANGUAGE - Amendments to trailer bill legislation to: 
(1) clarify the definitions of inclusive programs and children with exceptional needs, 
(2) clarify the intent of professional development for staff to develop best practices for inclusion,
(3) specify that applicants will need to demonstrate how they will consult with special education experts when determining how to expend funds, 
(4) prioritize applicants that demonstrate the ability to serve a range of disability types and a proportion of children with disabilities consistent with the regional rate of identification, 
(5) specify that grant funds may be used for universal design practices, 
(6) specify that grant recipients must participate in program evaluation activities, 
(7) specify that up to 1 percent of program funds may be used for a program evaluation, and 
(8) remove federal TANF funding from the program.

Federal
House Rejects Partisan, Harmful Farm Bill
This statement can be attributed to Olivia Golden, executive director of the Center for Law and Social Policy (CLASP).

(May 18, 2018) - Today, the U.S. House of Representatives rejected the Agriculture and Nutrition Act of 2018, also called the farm bill. Every Democratic member and 30 Republicans voted down the malicious legislation.

The House farm bill would have made deep, damaging cuts to SNAP-a highly effective program with a long track record of efficiently putting food on the table for millions of households each year and strengthening our economy. This legislation would have left millions of households, including working families, struggling to feed themselves.

The House farm bill-written by partisans behind closed doors-was meticulously designed to take away people's SNAP benefits, erecting barriers to assistance and miring states in bureaucracy. Today's vote reaffirms that tearing down this support doesn't make sense.

It is possible Republican leadership will push for another vote on the House bill next week. We urge members to remain steadfast and reject this attack on SNAP. At the same time, we encourage the Senate to craft a bipartisan farm bill that works for everyone, including people who rely on SNAP. We look forward to seeing the Senate bill and are hopeful it will protect and strengthen this crucial food assistance program.

CAPITOL HILL: House Committee Releases Draft TANF Reauthorization

Last week, the House Ways and Means Committee published draft legislation that would reauthorize the Temporary Assistance for Needy Families (TANF) program, including making significant changes to child care entitlement spending by states.

In its current version, the legislation proposes raising the cap by allowing states to transfer up 50% of TANF funds to CCDF. However, it would prohibit these funds from being spent on child care activities.  While CCAoA supports giving states more flexibility on child care investment, we fear that this proposal could negatively affect families and communities who depend on this support.

Child Care Aware® of America provided comments on the draft bill to the Committee that you can review here . The official introduction and consideration of the bill may happen soon. 

As of now, there is no Senate companion legislation.

California's next governor must choose children

The race for the next California Governor is on. At last Tuesday's gubernatorial  debate, all the candidates commented on early childhood education, making it a top issue in the next election. We couldn't be more thrilled! With just a few weeks until the June 5th primary, we urge you to register to vote and support candidates who Choose Children this election.

Dear Early Learning and Care Partners,

I wanted to share with you information from the federal Department of Health and Human Services, Office of Child Care (OCC) related to allocations of Child Care and Development Block Grant (CCDBG) funds in light of the increased budget appropriation for fiscal year (FY) 2018. The Consolidated Appropriations Act of 2018 includes $5.226 billion in  discretionary funding for the Child Care and Development Fund (CCDF) program. This is a $2.4 billion increase from the discretionary funding for federal fiscal year (FFY) 2017. Combined with the mandatory funding that was awarded in October, FFY 2018 funding for the CCDF program is $8.143 billion. California's federal CCDF allocation for FFY 2018 is now $827,230,552, which is an increase of $231.649 million from FFY 2017.
 
Due to the late notice in receiving our funding amount and the timing of the Governor's May Budget Revise, the plan is to have a robust input process in the summer. This lets us be more thoughtful on the use of these additional, discretionary funds. At this time, we don't expect these will be part of the 2018-19 state budget.
 
Per a recent OCC discussion with Shannon Christian, this additional funding provides an opportunity for lead agencies to invest in some of the expensive systems-building and infrastructure efforts that have come with implementing CCDBG reauthorization. These efforts include purchasing equipment for doing fingerprinting for background checks, building more consumer-friendly websites, and developing data systems that allow for integration across agencies. This funding also provides an opportunity to support quality improvement efforts for
informal child care that may currently be excluded from or underrepresented in such initiatives as quality rating and improvement systems and professional development.
 
This substantial increase in federal resources devoted to child care is a major milestone that presents significant opportunities.  We look forward to working with partners and stakeholders as we continue to implement the CCDBG in California and increase access to quality early learning and care for California's most vulnerable children and families.

Message regarding FI$CAL

Dear Executive Directors of Child Care  and Development Programs:
 
The Child Development and Nutrition Fiscal Services (CDNFS) Office is forwarding you a copy of the "Implementation of Statewide Accounting System: FI$CAL" letter. This letter notifies all contractors that the CDE is converting to a new automated statewide accounting system, the Financial Information System of California (FI$CAL) beginning July 1, 2018. The implementation of FI$CAL will impact certain deadlines as well as timing of apportionment payments.

CALIFORNIA CHILD CARE STUDY
We are writing to announce the launch of data collection for the California Child Care Study in May 2018. This is a state-wide study about subsidized child care and the families who use it. For this study, we will collect data about the local agencies that manage child care subsidies, the families who use that care, and the early care and education providers who serve them. State departments will use these data to inform policies and potential changes to child care services for eligible families. This study is being conducted by Child Trends (visit the Child Trends Web site at https://www.childtrends.org/) for the California Department of Social Services and the CDE. You can visit the California Child Care Study Project Web site at  http://www.childtrends.org/project/california-child-care-study/ for more information.
