The Education Initiative for the November 2014 Election (a teacher's union initiative) 

 

It will be on the ballot as an initiative this year. The ballot initiative was won by the teacher's union. It is not unlike a bill that came through when I was in the legislature copying in part the initial version of Washington's gross receipts tax, which has been amended innumerable times since it did not distinguish between profitability and non-profitability. So, even if your business is losing money, you owe the tax. It was a hard fought battle back in 2003, and it lost. 

 

It was submitted to the legislature last session. By statute, the legislature must hold hearings within the first 40 days of the session. If not (they can offer up alternatives), then the matter automatically goes to the ballot. No one wanted to touch it and it never came forward for hearings last session, thus, it will now be on the ballot. Senate Republicans had proposed a competing bill that would raise the tax on the gold mining companies. That got ignored by the Assembly but by Senate resolution, that was placed on the ballot.

This will no doubt be a driving force in the election and money will pour in against the teacher's union initiative. Nevadans have generally shot down tax initiatives, but demographics keep changing and it's all under the education banner. It's a bit scary to think about. It's a gross margin tax because Nevada's constitution forbids an income tax, so they have tied it to revenue rather than traditional income (profit).
