Heavy Attendance at LUAC Meeting
Regarding Short-Term Rentals in Carmel Valley
The Monday meeting of the Carmel Valley Land Use Advisory Committee (LUAC) at St. Phillips lasted two hours and had to be moved from the conference room to the sanctuary to accommodate the large crowd.
County official Melanie Barretti presented a proposed ordinance to regulate short-term rentals (STR's). Comments from attendees ranged from requests to ban them altogether as a commercial intrusion into residential areas to current operators who presented STR's as a needed alternative to hotels.
The committee will meet at a future date to make its recommendation to the Planning Commission.
Although CVA continues to believe that the best outcome for valley residents would be a complete ban on STRs, we feel that a realistic compromise would allow owner-occupied rentals but prohibit investor owned properties which are in essence hotels in residential zones.
According to our February survey conducted by the San Francisco firm Host Compliance, 78% of the 198 STR listings are investor-owned "whole houses," and only 18% are locally owned "partial homes," local residents renting out a room or two.
Work Continues on Highway One Climbing Lane

The project consists of widening northbound Highway 1 from Rio Road to Carmel Valley Road to provide a truck climbing lane. The truck climbing lane will connect to the existing climbing lane north of Carmel Valley Road. Construction of the Climbing Lane Project will provide better access and reduce congestion in the area.

Judge hears Rancho Cañada Case
On Friday, February 2, the Superior Court heard arguments from both sides in the suit brought by the CVA against Monterey County in response to the Board of Supervisors approval of the Ranch Cañada Village Subdivision in December 2016. Bill Parkin and Pearl Kan represented CVA.

The hearing lasted approximately an hour and a half.
CVA's counsel argued that the county has failed to comply with its General Plan and that the project approval violates the California Environmental Quality Act (CEQA). CVA's attorneys pointed out that the County has failed to create and implement a required Development Evaluation System (DES) to which this project should be subject, and that it has failed to update its affordable housing ordinance as required by the General Plan. The County General Plan required that the DES be completed within a year of adoption of the 2010 County Master Plan. It has still not been completed.
The General Plan also requires that the county's affordable housing ordinance be updated to increase the percentage of affordable housing units in new developments from 20% to 25%. The county has still not increased the affordability requirement in its local ordinance.
Importantly, the Rancho Cañada Village site is ideal for much needed affordable housing in Carmel Valley and was originally designated to exceed the General Plan's minimum 25% requirement, requiring 50% affordable units. Yet, the county reduced the affordable housing requirement for the site to below 20%.
CVA also contended that the project EIR was fatally flawed, in that it improperly conflated the infeasible original 281-lot proposal promoted by a different developer, which is no longer contemplated, with the new 130-lot version. Thus, the EIR failed to include an accurate project description, confusing the public and skewing alternatives analysis.
The Court took the matter under submission.

Our January 22 Memorandum to the County
Concerning Visitor Serving Units
The memo to the Planning Commission, excerpted below, concerns the allowance in the CV Master Plan of a total of 285 visitor serving units in the valley:
CVA is concerned that visitor-serving unit limits of 175 (west of Majorca) and 110 (east of Majorca) in subsections d & e, section CV-1.15 of the Carmel Valley Master Plan Supplemental Policies amended in 2013 should be adjusted downward to zero, given current traffic, water and other environmental conditions. And, in accordance with subsection g, the examination should now be undertaken to confirm that the limits should be adjusted downward to 0.
Cima Collina Sues the County
Over Denial of Special Events at Hilltop Ranch
After the Monterey County Board of Supervisors re-affirmed, 4 - 1, the Planning Commission's reversal of the "Administrator's Interpretation" that Cima Collina's Hilltop Ranch be allowed Special Events, the winery is suing the county, claiming that opponents waited too long to contest an April approval of events there,
and that neither supervisors nor county planning commissioners had jurisdiction to hear the matter.
As far as we can determine, no court date has yet been set, but we'll keep you informed. Reversal of the board's ruling, and the precedent set by it, would have an extremely negative impact on our valley!
