New Telemedicine Law

A bill to repeal the Law for Regulating the Telemedicine [Practice] in Puerto Rico and enact the new Law for the Use of Telemedicine in Puerto Rico was signed into law by the Governor of Puerto Rico on August 1, 2018. The new Telemedicine Law allows duly licensed physicians or health professionals in Puerto Rico to obtain a certification to practice telemedicine. The Law updated the definition of telemedicine so it now refers to the practice of medicine involving the remote diagnosis, treatment and medical education by means of technology resources to optimize health care services. Among others, it includes supplemental and instant services of a medical specialist, remote education to nursing, health professionals and medical schools. In the case of Rehabilitation Centers, the definition of telemedicine also covers physical, occupational and speech therapists.
Telemedicine rooms may be established in any health care facility, hospitals, medical offices, as well as in Rehabilitation Centers authorized by the Department of Education. Health care professionals of such entities authorized by the Puerto Rico Department of Health (PRDOH) to manage hospitals, primary health care and emergency facilities, and Rehabilitation Centers may use the telemedicine room(s) to consult a physician located in Puerto Rico with a valid license and the certification to practice telemedicine. In cases involving the use of telemedicine rooms to consult physicians or health care professionals within a Federal Jurisdiction, the PRDOH must establish the applicable procedure.
