Crackdown on SCRA Repo Violations - What Dealers Should Know

Last month, the Department of Justice reached a settlement with CitiFinancial, in which CitiFinancial agreed to pay over $900,000 to servicemembers whose vehicles CitiFinancial repossessed in violation of the Servicemembers Civil Relief Act (SCRA). In recent years other lenders such as Wells Fargo & Co. and HBSC Finance Corp. faced fines for the SCRA violations. High-dollar settlements make headlines, but auto financing originators and servicers of all sizes are on notice: ignore the SCRA at your peril. How Can You Confirm That Your Out-Of-State Lien Was Recorded?

TxDMV to Update eTAG and webDEALER Systems 

Later this year TxDMV will be updating the eTAG and webDEALER systems in order to make them more user friendly. The biggest change will be that the eTAG system (used for Buyer tags, etc.) will be located within webDEALER. This will allow dealers who are signed up for both systems to print a Buyer tag and complete a title application, without having to login to different TxDMV applications. All eTAG users will log into webDEALER with their current eTAG username and password to access eTAG even if they have not previously used the webDEALER system. All webDEALER users will log into webDEALER as usual. TxDMV will provide more information on these changes and future training in the coming weeks. 
Hurricanes Send Manheim Used-Car Price Index Higher

Americans replacing vehicles lost in Hurricanes Harvey and Irma pushed used-vehicle prices higher in September. In a related move, Manheim has refined its estimates of vehicle losses caused by those hurricanes. Wholesale used-vehicle prices increased 2.8 percent from August. The Manheim Used Vehicle Value Index, which measures wholesale prices adjusted for vehicle mix, mileage and season, rose to a record 134.9, a fifth straight monthly record high and 6.3 percent higher than a year ago.

Fiat Chrysler Recalls 710K Jeep Grand Cherokees, Dodge Durangos

Fiat Chrysler is recalling nearly 710,000 Jeep and Dodge SUVs in North America because an improperly installed brake shield could let water leak in and limit braking ability. The recall covers 2011 to 2014 Jeep Grand Cherokees and Dodge Durangos.

Dissecting Lawsuit over CFPB Arbitration Rule

A week ago, a lawsuit landed in the Northern District of Texas, Dallas Division where five national organizations and a coalition of associations located throughout Texas filed a legal challenge to the Consumer Financial Protection Bureau's rule that prohibits the use of class action waivers in arbitration clauses. Craig Nazzaro, who is of counsel in the Atlanta office of Nelson Mullins Riley & Scarborough, shared his assessment of the filing's contents and assertions exclusively with SubPrime Auto Finance News.

A Weird Buyer's Market Is Brewing for Hurricane Cars

The ink on the "total loss" insurance paperwork, like the 2007 Range Rover itself, was still wet when Morgan Moran began trying to buy his vehicle back after Hurricane Matthew last year. The insurance adjuster  had declared the vehicle ruined in a matter of seconds after noticing water in the spare-tire wheel well. After all, he had a busy schedule and contemporary cars are about as waterproof as a laptop computer. But Moran, a managing partner at Florida underwriter Moran Insurance, is a savvy deal maker  and was confident that his vehicle's electronic nerve center had stayed dry.

Used-Financing Trends Produce Stable September

Along with sharing some insights on how new vehicles are being financed in the Houston market following Hurricane Harvey, Edmunds reported that nationwide used-vehicle financing trends in September remained stable. Analysts determined the average term for a used-vehicle installment contract written in September came in at 66.81 months, down just slightly from a year earlier when it was 66.95 months. Five years ago, terms averaged 63.31 months in September, according to data Edmunds shared on Tuesday.

Task Force Busting Fake License Plates Forced to Shut Down

It's a massive problem in North Texas and it's driving by you everyday: fake paper license plates. Consumer Justice Investigator Cristin Severance found out the task force dedicated to catching those crooks is being forced to shut down. It's called the Dallas County Clean Air Task Force - a misleading name for a group whose mission is to get fake paper tags off the road. The task force is made up of four traffic enforcement deputies and ten detectives. They say 90 percent of the paper plates on the roads are fake. The plates are mainly used to hide either the vehicle or the driver from the law.

Automakers, Citing Costs, Consumer Demand, Say Miles Per Gallon Standards Unrealistic

Automotive trade groups told U.S. regulators they should revise light-vehicle fuel efficiency mandates approved in the final weeks of the Obama administration because the costs would be onerous and the standards do not reflect how cheap gas prices are affecting consumer demand, but they stopped short of asking for a specific reduction in the requirements for 2025. The comments to the EPA and the National Highway Traffic Safety Administration set up the next round in a battle between automakers and the state of California and environmental groups, which argue against any retreat from limits to greenhouse gas emissions.
