Thursday, 29 December 2011 Throughout the Occupy Movement, I have heard some interesting comments such as, the camps have become a place where the local homeless population has taken up residence - as though homeless people somehow do not have legitimate grievances with their government. Worse yet, many cities have used statutes designed to prevent the homeless from camping in public parks and other public areas to arrest protesters. I say worse yet, because missing in this discussion is one of the major disgraces of the latter part of the 20th century and early part of the 21st century - the rash of homelessness in...
Thursday, 29 December 2011 In October, Michael Morton walked out of a Texas Courtroom after his 1987 murder conviction was overturned because of new DNA evidence pointing to another man. To his credit, Williamson County District Attorney John Bradley joined with the Innocence Project in seeking Mr. Morton's release after it was discovered that the DNA of an unnamed male linked to the Mr. Morton crime through a bandana that also contained the blood of the victim was also found at the scene of a later murder in Travis County. The unnamed male is now under investigation for both crimes. But the damage was done. ...
Wednesday, 28 December 2011 Last week we received a press release from the city of Davis announcing that they will be closing the western bicycle path on Lake Boulevard, between Marina Circle and the Stonegate Country Club Entrance, until further notice. The path is unsafe due to the upheavals in the asphalt from the nearby stone pine trees. The release goes on to explain that the city will be blocking the bike path and southbound cyclists will be directed to use the southbound bicycle lane. Southbound pedestrians will be directed to cross Lake Boulevard and use the path on the east side. Northbound cyclists and...
Wednesday, 28 December 2011 It was an all too familiar story that appeared in Monday's Sacramento Bee which explored the reasons why CPS decided to return a child to her parents despite all commonsense and reason which stated otherwise. The specifics in this particular case are horrific. A one year old baby drowned in the family's backyard swimming pool in late 2006. The house the picture of neglect, infested with roaches with numerous health violations leading city inspectors to cite them "for an unsecured pool fence, the lack of a door closing off the garage from the pool, and a host of other health and... |

The Yolo County District Attorney's office has just spent three and a half years and unknown quantities of money to get the death penalty in what should have been a slam dunk case.
It is still unknown at this point whether the decision by the jury to impose the death sentence on Marco Topete will stand - given doubt expressed by one of the jurors, her dismissal from the sentencing phase ostensibly due to language barriers and recent revelations by one of the jurors who indicated to the Davis Enterprise that there was more to the story than just this.

It was a case that had all of the intrigue - a red-headed boy-next-door looking defendant, turned racist gun-nut, who shot a black man claiming self-defense. But ultimately the jury failed to buy the self-defense theory and convicted Christopher Smith, 31, of second degree murder with enhancements, that put the likely sentence to 45 to life.
If Christopher Smith looked like the boy next door, it is because he was one, with fiery red hair, two young kids, a clean record. But the recession had not been kind to Mr. Smith, he was in and out of work, struggling through his second marriage, and trying to take night courses at the local community college to build up his résumé.

Deputy District Attorney Suleiman Tokhi argued that this is a case where "bad liars meet good evidence." During these troubled economic times, crimes involving the stealing of metal pipes such as copper and turning them into recycle centers have increased in propensity.
In this case, co-defendants Nicholas Cummings and Penny Burkett would be convicted of first degree burglary and vandalism, with Mr. Cummings also got convicted of possession of burglary tools.
