Today, October 1st, a deadline passes that may be flying under the radar of most small businesses. A section of Obamacare's Affordable Care Act (ACA) created a new amendment to the Fair Labor Standards Act (FLSA) requiring a health insurance notice be sent to employees.

Therefore, I recommend you mail one of the below forms to your employees home addresses as the guidelines specifically state it cannot be handed out to your staff.

I have determined that most/all of my clients are subjected to the FLSA, therefore this requires action on your part immediately.

1. IF YOU OFFER HEALTH INSURANCE TO YOUR STAFF:
http://www.dol.gov/ebsa/pdf/FLSAwithplans.pdf. Simply open, fill out page 1, 2 and 3 and mail to your staff.

OR

1. IF YOU DO NOT OFFER HEALTH INSURANCE TO YOUR STAFF:
http://www.dol.gov/ebsa/pdf/FLSAwithoutplans.pdf. Again, open, fill out page 2 and mail to your staff.

This is step one of informing employees about the health insurance made available to them, and readying the marketplace for Obamacare - which has been delayed until 2015. And remember, if you have under 50 employees, your practice is not subject to Obamacare at this point. However, this form is still required to be mailed out to all employees.
