Advanced imaging techniques – for example, FLAIR, functional-MRI and DTI - are becoming more prevalent in both diagnostic and litigation settings. Yet there remain many unknowns about the value of these techniques as diagnostic tools, and there are significant questions about their admissibility. This is especially so with DTI (diffuse tensor imaging), a magnetic resonance imaging technique that purports to identify the unique directional movement of water molecules along muscle and neural tracts, something known as fractional anistropy ("FA"). The idea is that by identifying molecules with abnormally reduced FA values, injury to the linkages and structures of white matter tracts in the brain can be identified

In a litigation setting, a color-coded image can be created, which purports to show the “damage” or “scars” on a person’s brain. Much about the technique, especially as it is employed by practitioners who frequently testify, remains a mystery, and the underlying data is particularly subject to manipulation. This presentation will introduce you to the science of DTI and discuss how it works, with reference to some of the leading literature on the topic. Actual DTI slides will be shown, but particular attention will be paid to how data is collected and plotted and then turned into an image. Different legal challenges will be discussed as will cross-examination techniques.
