These days it seems the rules and regulations that govern our industry are changing almost daily.  It was with concern that I learned so many within Wyoming's construction industry were unaware that the requirements for classifying and labeling chemicals is changing,  and you only have until December 1st for your employees to be familiarized with the new Global Harmonization System (GHS) for classifying and labeling those chemicals.

We hope the information in this email will help you get up to speed on what is required as well as inform you of some upcoming opportunities to meet the GHS education requirements.

Sincerely,

Josh Carnahan
President

WHAT IS GHS?
According to the U.S. Department of Labor, The Globally Harmonized System (GHS) is an international approach to hazard communication, providing agreed criteria for classification of chemical hazards, and a standardized approach to label elements and safety data sheets. The GHS was negotiated in a multi-year process by hazard communication experts from many different countries, international organizations, and stakeholder groups. It is based on major existing systems around the world, including OSHA's Hazard Communication Standard and the chemical classification and labeling systems of other US agencies.

WHAT DO I NEED TO DO TO BE COMPLIANT?

By December 1st, 2013, all employers that work with chemicals must Train employees on the new label elements and safety data sheet (SDS) format.

By June 1st, 2015, employers and chemical manufacturers, importers, distributors, etc., must be in compliance with all modified provisions of this final rule, except, distributors shall not ship containers labeled by the chemical manufacturer or importer unless it is a GHS label.

And by June 1 of 2016, employers must update alternative workplace labeling and hazard communication program as necessary, and provide additional employee training for newly identified physical or health hazards
