The FMHCA Board is excited to be offering another excellent state wide conference for all Mental Health Professionals from Feb. 5th -7th in Orlando Lake Mary Marriott (same hotel as last year). 

 

In fact, we are  offering another excellent two day Qualified Supervisor Training Program as a Pre-Conference workshop. This year's workshop will be facilitated by Dr. Stephen Guinta. The cost for this two day workshop will be $240 if register by Nov. 14th. The cost will increase to $270 if register after Nov. 14th.

Students are the future of our profession!! Medicare Provider Status is key for their professional future. So getting them involved in legislative advocacy makes good sense.


Consider reaching out to your colleges and universities. Contact the program chairs and let them know what your chapter is doing to promote Medicare Provider Status.


Recently the Gulfcoast Mental Health Counselors legislative committee did just that. The timing was perfect because an advocacy project was part of this term's Introduction to the Counseling Profession course requirements. The professor provided our committee's contact information. Students reached out. They learned about the history of Medicare Provider Status for LMHC's. They learned why in the current healthcare environment LMHC's must be full participants in all segments of the healthcare community. These students armed with knowledge set out to write letters to their legislators.


Build relationships with counseling programs! The core of our work as counselors is the "relationship." Use those relationship skills to build pathways from those of us working in the field to those just starting out. Tell students why it's critical for them to get involved in legislative advocacy. Their future depends on it.

THE QUESTION OF ETHICAL/MORAL AND THE LEGAL CONSIDERATIONS FOR MEDICAL MARIJUANA

There is a rising concern for the writing of the law pertaining to the use of medical marijuana in Arizona. According to a recent survey from the Arizona Department of health Services, there are over twenty licensed and registered physicians accountable for writing the majority of prescriptions for medical marijuana in the state of Arizona.
 

In 2010, the voter-approved law in Arizona allowed the use of the drug by patients suffering from a list of specific medical conditions, ranging from glaucoma and AIDS to any chronic or debilitating condition that leads to severe and chronic pain. Nearly 53,000 people have qualified under the law to purchase up to 2� ounces of marijuana every two weeks. The 2010 law also includes a provision to expand the list of conditions for which marijuana can be legally prescribed.
 

When the law was initially passed, there were reports of physicians setting up a suspicious practice in the very facility where the medical marijuana was sold. When the hordes of potential clients entered the licensed marijuana dispensaries to sell this product, prescriptions were freely written. When the physician was interviewed and asked, "How many prescriptions were written to your clients"? He replied, "All of them". When questioned further, the physician readily reported that "No one was turned down".


It became quite apparent that there were no medical examinations nor questionnaires provided to his clients. It was only a matter of paying the fee and they were happily provided a prescription for their "medical marijuana". There was no accountability or verification of any medical need for this drug. It became clear that when the Department of health Services gathered statistics regarding the growing number of medical marijuana recipients in Arizona, the results demonstrated that there were alarming numbers of individuals who received the drug without a justifiable medical issue to support their claim.


In Arizona, there are 27,000 licensed physicians, 472 of them were responsible for certifying nearly 36,350 patients from July 2012 to June 2013. In addition, 99 naturopaths, who are those doctors that practice both traditional and natural medicine, certified nearly 27,280 patients.


Of major significance is the fact that twenty-one of those naturopaths approved 72% of the state's medicinal marijuana recommendations. The conclusion is that many patients are avoiding their primary care physician and seeking out "certification mills" to acquire this drug.

There are a growing number of concerns about the legality of marijuana. This is largely because marijuana remains illegal under federal law.


There is a movement afoot in Arizona to make serious changes to the law with regard to dispensing medical marijuana. The change would require "clear and convincing evidence" that there is some benefit from the use of marijuana for any specified medical condition. This clearly means that there must be convincing evidence that marijuana will help either treat the condition or at least provide some relief.


Whenever we begin our dialogue with the medical marijuana issue, we need to keep focused on what happened in Arizona when the state legalized it. Young physicians began to associate with the authorized marijuana dispensaries and were provided an office to prescribe. Individuals, by the droves, procured prescriptions and were legally permitted to purchase said items without verifying their medical need.


Although I agree, in part, with the medical prescribing and its use of marijuana, there is a tremendous abuse risk without oversight. Unless there is an accountability by the DEA, as they now do with class II prescriptions, I vote "Absolutely No".

Supervision Question and Answer

Supervision is an extremely important aspect to gaining licensure. After graduating supervision tends to be one of the first topics on any new graduates mind and with that a lot of unanswered questions may come up. After last month's article regarding how to turn in supervision hours, a lot of Registered Interns had follow up questions and below are the follow up questions and answers:



  1. What does Florida require for supervision hours? 100 hours of supervision in no less than 2 years.
     
  2. If an intern has a caseload of more than 15 clients a week, does the intern require an additional hour of supervision? Yes, for every 15 client hours an intern needs one hour of supervision so, if an intern has more than 15 clients in one week, they are required an additional hour of supervision for that week.
     
  3. If an intern has 2 supervision hours in one week, do both hours of supervision count towards licensure? Yes, any amount of supervision will be counted towards the 100 hours of supervision.
     
  4. What if an intern ends up with all 100 hours of supervision in less than 2 years? The intern will still be required to continue supervision until the 2 year minimum, 1500 client hour AND 100 hours of supervision have been met. Regardless is one or the other is met prior to the 2 year minimum.
     
  5. Can an intern have more than one supervisor? Yes, many interns will have more than one supervisor for situations of canceled supervision hours or to obtain group supervision from one supervisor and individual from another. There are many benefits to having more than one supervisor.
     
  6. If an intern loses a job, has an emergency, moves out of town etc. and has a break in obtaining hours for licensure can the intern "make up" lost hours by carrying a heavier case load? In order to "make up" hours implies that the intern is attempting to obtain all of the minimum requirements by the 2 year minimum. However, it is important to note that the 2 years is a minimum and not a maximum. Meaning that it's a minimum for everyone and can be done but, also accounts for issues of losing a job, moving, family emergencies etc. and currently there is not a maximum limit on being a registered intern, meaning if you finish requirements after the 2 year minimum you will still be allowed to become licensed.

It is important to remember the basics of becoming licensed such as 1 hour of supervision is required every 15 hours of face to face clinical hours. Supervision must be done at a minimum of every 2 weeks, even if you have not completed 15 hours of clinical face to face. If you have more than 15 clients a week, you need an additional hour of supervision. So if you have 24 hours of face to face in 1 week you are required 2 hours of supervision for that week. However, remember no matter how fast you complete the 1500 hours or 100 hours of clinical supervision you STILL have to wait a minimum of 2 years, all requirements must be met. Also important to remember is that the 2-year requirement does not mean that the intern has to be working consecutively during that 2-year period, or that the hours have to have been spread out evenly during the 2-year period, this would be extremely difficult to achieve for anyone.

I've been licensed and working for a while but I really want to be in private practice. What do I need do first?

 

I'm a Registered Intern; can I have a private practice?

 

These questions and others have been posed to me over the years. This commentary is an exploration of initial issues related to creating a private practice. I start with issues of interest to Registered Interns. Qualified Supervisors and other licensed mental health professionals may be interested to know this information. That being said, it is imperative that the clinician seeking to establish an independent private practice become familiar with topics related to "formulating, developing, and maintaining business savvy in the provision of professional services" (Woody, 2013). Some specific costs and procedures related to an independent private practice business are identified to prompt you to consider.

 

Let's look at the Florida statute regarding independent private practice. The quote is from the section of law for social work practice and we can substitute marriage and family therapy or mental health counselling as the wording is the same.

 

Chapter 491, our practice act states this:

491.005 Licensure by examination.
491.005(1)(c) . . .

"The experience requirement may be met by work performed on or off the premises of the supervising clinical social worker or the equivalent, provided the off-premises work is not the independent private practice rendering of clinical social work that does not have a licensed mental health professional, as determined by the board, on the premises at the same time the intern is providing services."

 

So, what are the ramifications of this statute?

The fact that a licensed professional must be on premises at all times that the intern is seeing a client automatically makes it quite impractical for an intern to own a practice. They would have to pay a licensed individual to be present at all times they meet with clients or hope that the professional happens to have their own clients concurrently (private communication).

 

HOWEVER, don't get too excited Interns. This next part is also very important. The Florida Administrative Code/Rule 64B4-2.003 now states, "Supervision provided by the applicant's therapist, parents, spouse, former spouses, siblings, children, employees[emphasis added], or anyone sharing the same household, or any romantic, domestic or familial relationship shall not be acceptable toward fulfillment of licensure requirements. For the purposes of this section, a supervisor shall not be considered an employee of the applicant if the only compensation received by the supervisor consists of payment for actual supervisory hours.

 

Hiring someone for you practice who can be present, see their own clients and/or otherwise participate in the functioning of the practice and then provide your supervision is prohibited as that represents a conflict of interest (private communication)".

 

This current law is being revised and the proposed language is this:

 

"So in order to legally operate a private practice, one would need to hire a licensed professional to be present at all times that you are seeing clients and then you would need to have separate person serve as your qualified supervisor. Of course, there are folks out there who defy these laws and rules. The state is well aware that this nonsense is happening regularly and so just this year, moved to clarify the law so that those who want to stick to technicalities and ignore the spirit of the laws and rules would be without excuse. The text of the proposed 491.005 (4) (c) reads (copied directly from the bill):

 

 

111 A licensed

112 mental health professional must be on the premises when clinical

113 services are provided by a registered intern in a private

114 practice setting. A registered intern may not engage in his or

115 her own independent private practice 

 

                      

 

What are the costs associated with private practice?

Here are some of the costs and procedures that come immediately to mind as I started writing this article. It is by no means a complete list of things to consider and prepare for.

 

  • Legal and accounting services

    I cannot emphasize strongly enough that having the ability to consult with an attorney about all manner of legal questions as needed is a boon to the entrepreneur. There are some questions that only an attorney should address. An accountant may help with understanding some of the tax implications related to independent contractor (1099) status versus being an employee (W9) in a practice.


     
  • City/county licenses

    City and county jurisdictions typically require a business license. Licensed professionals (contractors, plumber, doctors, and mental health practitioners should check within their county and city offices for information about the fees associated and procedures and documentation required for the license. Some institutions have indicated that they do NOT provide business licenses to unlicensed individuals, so Registered Interns should consult with an attorney licensed to practice in Florida


     
  • Malpractice insurance; general liability insurance

    Registered interns and licensed individuals should strongly consider securing the protection offered by malpractice insurance. If you have had your policy for a while and secured it while working for an agency or other business you should contact your provider to determine whether or not independent private practice is included in your current policy or be added to the current coverage.


     
  • General liability insurance

    if you are renting space from another practitioner or other situation it is advisable to determine if that 'landlord' maintains general liability insurance for the property. If not, you may want to consider seeking office space elsewhere. What would you do if one of your clients were injured on the property?


     
  • Developing policy and procedures including forms and documents for completing client files

    This particular procedure deserves some additional attention and I will write about it in the future but policy and procedure manuals need to include many issues including but not limited to: confidentiality policies related to all means of communication (phones, email, text, social media, releases of information; your availability; how crises will be addressed; billing and fee collections procedures and more.

Once you have adequately developed the plan for your practice and ensured that you are meeting all legal requirements, you can begin to attend to some of the more creative and fun aspects of entrepreneurship. Please feel free to send comments or questions about this topic directly to Dr. Waltz.

Clinical members may join both FMHCA and AMHCA with UNIFIED DUES of just $234.00.   To take advantage of dual membership, you must join through AMHCA.  Visit www.amhca.org and join online.

 

Others may join via www.flmhca.org by downloading a membership form and mailing it with your payment, or you may make a payment directly through our website.  Keep in mind we have a few membership options:

 

$96.00 Clinical - All LMHC's or CCMHC's

$80.00 Regular - All registered interns or non-licensed professionals

$40.00 Student - Full time graduate student

$40.00 Retired Clinicians - License Retired
