Annual Emissions Reports Are Due May 1st
 
Permitted sources should have received their 2016 Annual Emissions Report forms that are due to the Illinois EPA by May 1st. If you did not receive your report and need assistance, click here.
  
If you need assistance in calculating your facilities emissions, the Illinois EPA Bureau of Air has some helpful emission calculators online at: www.epa.state.il.us/air/aer  for some of the common types of equipment including: Asphalt Plants, Boilers, Grain Elevators, Concrete Batch Plants and Quarries/Rock Crushing.

2017 Annual Emissions Reports Being E-Mailed to Companies Next Year
 
Beginning with the 2017 reporting year, the Bureau of Air will no longer be mailing paper Annual Emissions Reports. Instead, Illinois EPA will be sending each facility's report to them via e-mail as a PDF attachment for viewing and printing using the free Adobe Acrobat Reader.  When submitting the 2016 Annual Emissions Report, the owner/operator should make sure the e-mail address for the Annual Emissions Report contact is up-to-date to ensure they receive their 2017 reporting forms.  Updates/corrections to your facility's contact e-mail should be provided on the 2016 reporting form.  Additionally, in the near future, the Annual Emissions Report web page will contain a link for sources to submit a change/update to the facility's contact information.
 
SBEAP TIP: As more and more official correspondence relies upon electronic communications, it may be helpful for your company to create a dedicated e-mail address for these types of reports and notifications from regulatory agencies or other important contacts. Topical or dedicated e-mail addresses eliminate the need for updating with multiple agencies when staff changes occur, reduce the chances of the communications being overlooked, and could allow multiple users to have access to important email communications without interfering with individual staff members accounts. Example e-mail addresses could be: [email protected] or [email protected].

Illinois EPA Offering Spring Smoke School: Evaluation of Visible Emissions April 11-13

The Illinois Environmental Protection Agency will offer a course in the Evaluation of Visible Emissions during the week of April 10, 2017. The class will run from Wednesday, April 12 through Thursday, April 13, 2017. Class begins at 9:00 AM each morning with registration beginning at approximately 8:00 AM; everyone must sign in one time only.

All newcomers attending for initial certification (not recertification) are expected to be present for a lecture session at 1:00 PM on Tuesday, April 11th; persons recertifying are welcome to attend the lecture as well. The lecture will include discussion of visible emissions and the finer points of reading opacity. The lecture will be held at the Ramada Limited Motel, 3281 Northfield Drive, Springfield, Illinois.

A block of rooms has been set aside for the session, so please mention you are attending "Smoke School" when making your reservations. The Illinois Environmental Protection Agency does not charge a fee for this instruction. All participants must arrange for their own meals and lodging; however, all materials necessary for the course will be supplied with the exception of writing tools and a clipboard. Please be reminded this class is held outside, so dress appropriately and bring your own lawn chair.

The Facts about IEMA Emergency Release Notification

A.  Immediate telephone notification shall be given by the owner or operator of a facility when a release equal to or exceeding the reportable quantity of an extremely hazardous substance [See 40 CFR 355 for a listing of extremely hazardous substances (EHS)] or a CERCLA hazardous substance [See 40 CFR 302.4 for a listing of Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) hazardous substances] occurs at the facility.  
  
In such incidents, notifications are to be made to the following:
  
 1. Illinois Emergency Management Agency (IEMA)/State Emergency Response Commission (SERC) at 1-800-782-7860 (within state) or (217) 782-7860 (when calling from out-of-state);

 2. Local Emergency Planning Committee (LEPC) that is likely to be affected by the release.  The LEPC telephone number(s) may be obtained from the IEMA Website at:

3. National Response Center (NRC) at 1-800-424-8802 (if the substance is a CERCLA hazardous substance).     
  
Note: Transportation - related incidents only require 9 - 1 - 1 notification.
  
B.  Immediate telephone notification is also required if an incident or accident involving a hazardous material [See 49 CFR 172.101 for a list of hazardous materials] occurs which results in:
  
 1)  a member of the general public is killed;  2) a member of the general public receives injuries requiring hospitalization;  3) an authorized official of an emergency agency recommends an evacuation of an area by the general public;  4) a motor vehicle has overturned on a public highway;  5) Fire, breakage, release or suspected contamination occurs involving an etiologic agent;  6) Any release of petroleum (or oil) that produces a sheen on nearby surface water [See 41 IAC 176.340 Reporting and Cleanup of Spills and Overfills (USTs)] and/or threatens navigable waters;   7) Any spill or overfill of petroleum that results in a release to the environment that exceeds 25 gallons (25-gallon reporting threshold for USTs   only). [See 41 IAC 176.340 Reporting and Cleanup of Spills and Overfills (USTs).]   ASTs are not subject to the 25-gallon spill reporting threshold in 41 IAC 176.340  but are subject to 29 IAC 430.
  
In such incidents, notification shall be made as noted in Paragraph A, above, except no notification is required to the NRC, except items 6 and 7 (oil that impacts water and overfills emanating from underground storage tanks).

SBA Environmental Roundtable Meeting Regarding EPA's TSCA 6(a) Proposals: Regulation of Trichloroethylene (TCE) Use in Aerosol Degreasing, Use in Spot Cleaning by Dry Cleaners and Use in Vapor Degreasing
  
The next U.S. Small Business Administration, Office of Advocacy Environmental Roundtable will meet March 10th 10:00 a.m. to noon.

Trichloroethylene (TCE); Regulation of Certain Uses Under Toxic Substances Control Act (TSCA) Section 6(a)
  
On December 16, 2016 EPA published its first Toxic Substance Control Act (TSCA) Section 6(a) proposed rule, since the passage of the Lautenberg Chemical Safety Act, to regulate certain uses of TCE.  EPA proposed a determination of unreasonable risk for TCE use in aerosol degreasing and use in spot cleaning by dry cleaning facilities. The proposal includes a prohibition on the manufacture (including import), processing, and distribution of TCE for these uses, including with downstream notification requirements.  EPA is certifying, under the Regulatory Flexibility Act, that the proposed changes will not have a significant economic impact on a substantial number of small entities.  The comment deadline for the proposed rulemaking is March 16, 2017.

On January 19, 2017, EPA published its second rule to regulate TCE use under Section 6(a) of the Toxic Substances Control Act (TSCA) for Trichloroethylene (TCE).  In this proposal, EPA proposed a determination of unreasonable risk for TCE use in vapor degreasing.  The proposal includes manufacture (including import), processing, and distribution of TCE for these uses, with downstream notification requirements.  EPA has prepared an initial regulatory flexibility analysis under the Regulatory Flexibility Act, examining the impacts of the proposed rule on small entities.  EPA also convened a SBREFA panel to consider the impacts of the proposed changes on small entities in 2016.  The comment deadline for the proposed rulemaking  is April 19, 2017.
  
Roundtable meetings are open to all interested persons, with the exception of the press, in order to facilitate open and frank discussion about the impacts of Federal regulatory activities on small entities.  Agendas and presentations are available to all, including the press.  Anyone who wants to receive roundtable agendas or presentations, or to be included in the distribution list, should forward such requests to [email protected].  The purpose of these Roundtable meetings is to exchange opinions, facts and information and to obtain the attendees' individual views and opinions regarding small business concerns.  The meetings are not intended to achieve or communicate any consensus positions of the attendees.
                                                      
DOE and USDA Issue Notice of Intent for Biomass Research and Development Initiative
The U.S. Department of Energy (DOE) Office of Energy Efficiency and Renewable Energy's (EERE's) Bioenergy Technologies Office in coordination with the U.S. Department of Agriculture's (USDA's) National Institute of Food and Agriculture (NIFA) is announcing its intent to issue a Request for Applications (RFA) through the Biomass Research and Development Initiative. Projects funded through this RFA, titled "Fiscal Year 17 Biomass Research and Development Initiative (BRDI)," will help develop economically and environmentally sustainable sources of renewable biomass, increase the availability of renewable fuels and biobased products and diversify our energy portfolio. For more information  click here.

The Illinois Small Business Environmental Assistance Program (SBEAP) is a federally mandated program to assist small businesses with their environmental requirements. SBEAP is a free, confidential, and non-regulatory resource for small business owners to help them understand and comply with state and federal air pollution regulations.
 
We offer a range of services to assist small businesses, including training seminars and workshops, current permit forms and instructions, links to various Illinois state agency environmental regulations, a quarterly newsletter with regular updates and information on pending and recently amended rulemakings, fact sheets, brochures and guides related to a wide range of small businesses, and links to a directory of environmental consultants.
