Legislative Alert - No On H.3081!

We sent information about Rep. Linsky's H.3081 earlier this week - now is the time to take action!

Please call your state representative and state senator at (617) 722-2000 - urge them to oppose H. 3081 An Act Establishing Extreme Risk Protective Orders

No on H.3081! GOAL calls on the legislature to reject this soundbite legislation and instead take up mental health legislation that will provide both care and public safety while respecting civil rights and due process. People with mental health issues deserve our help and our respect and we can do much better than this bill promises to provide.

Plan to seize guns hits opposition (H.3081)
Law would allow 'extreme risk protection order'

GOAL Note: Thank you Senator Tarr for your leadership against this insidious legislation.

BOSTON — Gun owners could have their firearms taken under a controversial plan to keep weapons out of the hands of people with mental illness or who are deemed dangerous.

The legislation, if approved, would allow police, health care workers, family members and others to ask a judge to issue an “extreme risk protection order” allowing police to revoke the firearms license, for up to a year, of someone considered a danger to themselves or others.

Police could seize firearms belonging to that person, as well.

Gun control advocates say the measure, modeled on domestic violence protection orders that have been on the books for decades, will reduce gun violence and suicides that claim tens of thousands of lives each year.

Westminster To Be Continued

Despite Illegal Actions By Town Of Westminster - Zoning Board Meeting Yields No Result.

GOAL Note:  The residents who are complaining about the existence of the range have no legal standing as it is protected by MA law.

WESTMINSTER – The Zoning Board of Appeals continued a hearing on an appeal of a cease-and-desist order on the Westminster Rod and Gun Club to May 2, after hours of testimony from club members, neighbors and abutters.

The hearing is the culmination of a long dispute between those living near the gun club who say they have a right to enjoy their backyards, and members of the club who say they believe their gun rights are in jeopardy.

Update On GOAL's Civil Rights Lawsuit

Update on our federal civil rights lawsuit against AG Healey. We had a scheduling hearing yesterday, trial date is May 2018, with Judge William Young.

Case info - this is from the court document linked below, which includes the upcoming schedule.

Plaintiffs' position.  This case involves three distinct constitutional challenges to a ban on popular firearms and standard magazines enforced by multiple Massachusetts government agencies. The lengthy enforcement history of the ban, the 2016 Notice of Enforcement radically changing the scope of the ban, and the Defendants' shifting explanations of the Notice suggest the
standard discovery limits will not suffice.

Plaintiffs require fact discovery to illuminate Defendants' motives, and changing interpretations, as well as to challenge the factual foundation and fit of Defendants' expert evidence. Plaintiffs propose serving each Defendant 10 interrogatories, 10 requests for admissions, and 2 sets of requests for the production of documents.

Plaintiffs propose deposing each of the Defendants or a representative of their respective agency, individuals responding to questions regarding the scope or applicability of the ban or Notice of Enforcement, and the fact or expert witnesses identified by Defendants.

Gun Culture 2.0

Occasionally I’m reminded that there are still a great many firearms enthusiasts clinging to the notion that in order to be a shooter and 2nd Amendment supporter, a person must fit a certain mold. While 99% of the firearms community seems to have pretty much gotten over the gender and race thing, I still notice quite often that you’d better be pretty enthusiastic about praying with the group and voting Republican if you want to be a member of the “club.”

It appears we still often require our 2nd amendment supporters to be pretty far right wing in both religion and political party. That’s all well and good for small groups and clubs here and there if that’s the overwhelming desire of their members; however, if our intention is to bring in more shooters and future 2nd Amendment advocates, how about we focus on the Bill of Rights and try not to alienate potential recruits with needless political party and religious affiliation grandstanding.  It does nothing for the cause, even if it does make us feel better about ourselves.

Lawrence Seeks Help to Stem Recent "Gun Violence"

More proof that our highly restrictive gun laws are ignored by criminals.

LAWRENCE, Mass. (AP) — The city of Lawrence is asking for extra help as it tries to stem a recent spate of gun violence that left two people dead in separate weekend shootings.

Police Chief James Fitzpatrick is asking for extra commitment from state and federal authorities, and a special prosecutor to pursue gun crimes in federal court where penalties are often more severe.

Fitzpatrick says there have been 10 incidences of gunfire in the city this month alone. The two fatal shootings last weekend bring the number of homicides to six this year.
