7 Tips for Complying with new Wage-Hour Regulations

Albert Brannen of Fisher Phillips Employment Law Firm recommends these 7 things when considering the new overtime regulations and compliance:

1. Assume the regulations will go into effect at the end of December
2. Analyze which of your employees are effected by the new rules
3. D evelop FLSA-compliant pay plans for those employees
4. M ake sure you have an accurate record of all hours worked by     "nonexempt" employees
5.  I f you have any other employees whose exempt status may be in the "gray area" because of their duties, now is a good time to change the pay plan and/or duties of these employees to get them into compliance
6. S tay abreast of new developments in this area

       The new "white-collar" overtime rules have raised many questions.  For example:

Q. May employers use bonuses to satisfy part of the new standard salary level test?

Q. What's the difference between a discretionary bonus and a non-discretionary bonus?

Q. May employers make a catch-up payment in the event that an employee doesn't receive enough in non-discretionary bonuses and incentive payments (including commissions) in a given quarter to remain exempt?

Q. Does the Final Rule change how employers may use bonuses to satisfy the salary level for highly compensated employees (HCEs)?
