REALTOR® Emeritus: April Deadline
April 2 is the deadline to complete certification forms for REALTOR® Emeritus status for approval in May at the REALTORS® Legislative Meetings & Trade Expo in Washington. REALTOR® Emeritus status recognizes members who have forty years of membership and have completed at least one year of service at the national association level. For applications filed through 2019, the one-year service requirement may also be met through service at the state or local level.

President Signs the "Tax Cuts and Jobs Act"
On December 22, 2017, President Trump signed the "Tax Cuts and Jobs Act". The U.S. House and Senate approved the conference agreement of the "Tax Cuts and Jobs Act" earlier in the week.
All individual provisions of the measure are generally effective after December 31, 2017 for the 2018 tax filing year and expire on December 31, 2025 unless otherwise noted. The provisions do not affect tax filings for 2017 unless noted.
NAR will be providing ongoing updates and guidance to members in the coming weeks, as well as working with Congress and the Administration to address additional concerns through future legislation and rulemaking. Lawmakers have already signaled a desire to fine tune elements of the "Tax Cuts and Jobs Act" as well as address additional tax provisions not included in this legislation in 2018, and REALTORS® will need to continue to be engaged in the process.

Legal Question of the Month
QUESTION:
I represent a buyer who has made an offer of $150,000 on a house listed at $180,000. The listing agent called and told me that the sellers were rejecting the offer and that the sellers would take no less than $170,000. My buyer then submitted an offer for $170,000, which the sellers promptly accepted. Although everyone in this transaction is happy, my broker believes that the listing agent breached a fiduciary duty owed to the sellers by telling me the bottom line price the sellers were willing to accept. Is my broker correct?
ANSWER:
POTENTIALLY, YES. Michigan case law has held that a broker representing a seller may not suggest to a purchaser that the seller will
accept less than the stated price.

(1933). Under your circumstances, unless the sellers gave their agent permission to disclose the minimum price that they were willing to
accept, the listing agent may have breached a fiduciary duty owed to her sellers.
