Two Louisiana Acts Effective as of August 1, 2014

 

Act 62 by Rep. Lopinto and Act 203 by Rep. Ponti were supported by Louisiana Home Builders Association (LHBA) and become effective on August 1st, 2014.  

Act 62 of the 2014 Legislative Session revamps the crime of contractor fraud. LHBA worked with law enforcement and prosecutors to make the statue not only more usable but also to provide guidance for district attorneys.  The criminal penalties for Act 62 are the same as other fraud statues but under the new act, a person convicted of residential fraud has to also make full restitution to the victims.

 

Changes were also made this session to the Underground Utilities and Facilities Damage Prevention Law. Act 203 by Rep. Ponti allows for off set markings to now be used if the surface over the buried line is to be removed. These off set markings are typically parallel to the line and indicate the distance of the buried line.  Mark by times can now also be extended but only if mutually agreed upon by the excavator and operator.

Urge Your Representative to Co-Sponsor H.R. 5078, the Waters of the United States Regulatory Overreach Protection Act of 2014

 

Second, EPA's proposed expansion of the CWA will interfere with the ability of individual landowners to use their property and negatively impacts economic growth.  Specifically, EPA's proposal will dramatically increase the cost and time needed to obtain a wetlands permit prior to home construction, which will greatly impact the fledgling housing recovery.  H.R. 5078, the Waters of the United States Regulatory Overreach Protection Act, has been introduced by Representative Steve Southerland (R-FL) and will prevent the EPA from regulating ditches, mudflats, prairie potholes and other water features under the CWA.  Your representative should be made aware of the EPA's unwarranted intrusion into land use and urged to become a cosponsor of H.R. 5078.

Urge Your Senators to Support S. 1217, the Housing Finance Reform and Taxpayer Protection Act of 2014

 

NAHB strongly supports Senate-led efforts to reform the US housing finance system, and our allies in the Senate are asking us to help create momentum for the housing finance reform legislation.  A true national economic recovery cannot occur until the housing industry regains its pre-depression levels.  The one way to create a more robust housing market is through passage of S. 1217, the Housing Finance Reform and Taxpayer Protection Act of 2014.  This legislation preserves the affordable 30-year fixed rate mortgage, inspires more private capital to return to the market, and protects the American taxpayer from future bailouts.  S. 1217 was approved by the Senate Banking Committee with bipartisan support in May, but has stalled before reaching a full vote by the US Senate.  Your help is needed to demand Senate action on S. 1217.
