Government - Less Is Best
For most of us, less government is best government. In that sense, a legislative session that does absolutely nothing is perfectly acceptable. The State of Montana has the right idea in letting their legislature meet for only six weeks every other year. When I was actively lobbying in the Capitol for passage of concealed carry, former Missouri Senator Larry Rorbaugh had the right idea: You want a new law on the books, get rid of an old one. So, judging from this perspective, freedom-loving Missourians had a pretty good session this year.
Some Good, No Bad, No Ugly
This year we added 18-year-olds who have served or will soon be serving in the military to those who can get a ccw permit, a good first step to getting that right for all Missouri 18-year-olds, and sure to get the anti's panties in a wad. Those who took the required firearms safety training course for a ccw license prior to 8-28-2011 and qualified under the old range qualification rules (70 rounds and qualification with one gun), but who had not gone to their sheriff and completed the permit process, are now grandfathered-in and do not have to come back to qualify under the new range rules. There are several other good changes to the Missouri weapons law; see Kerry Messer's update, below. Thanks to Kerry's excellent efforts, there are no Bad or Ugly changes to our laws to report!

2012 MISSOURI LEGISLATURE
End-of-Session Update

On the last day of the 2012 Legislative Session, ending at 6 pm on May 18, 2012, two bills we expected to see Truly Agreed and Finally Passed did make it through both Houses.
First is HB 1647. HB 1319 died in the Senate due to unrelated problems; however, all the provisions of HB 1319 were added to HB 1647 in the final hours and adopted in the Senate. This bill, now headed to the Governor's desk, contains the following:
HB 1647
This substitute reenacts a provision that was repealed by House Bill 294 in 2011, which allows the use of certain otherwise unlawful weapons if the weapon is being dealt with as a curio, ornament, or keepsake.
The substitute lowers the age at which a person can obtain a concealed carry endorsement from 21 to 18 years of age if the person is a member of the United States Armed Forces, honorably discharged from the United States Armed Forces, a member of a military academy, or a member of the Reserve Officers' Training Corps; is a citizen of the United States; and has assumed residency or is stationed in Missouri.
Any person who has a valid concealed carry endorsement and is lawfully carrying a firearm in a concealed manner may briefly and openly display the firearm to the ordinary sight of another person, unless the firearm is intentionally displayed in an angry or threatening manner, not in necessary self-defense.
The substitute allows an individual over 18 years of age who has been adjudicated incapacitated under Chapter 475, RSMo, has been involuntarily committed under Chapter 632, or has had a Missouri adjudication or commitment that results in a firearms disqualification pursuant to 18 U.S.C. Section 922(d)(4) or (g)(4) is allowed to file a petition for the removal of the disqualification to ship, transport, receive, purchase, possess, or transfer a firearm. The procedures for filing the petition and the rules of evidence are specified in the substitute. The substitute repeals current provisions found in Section 475.375, relating to these petitions. The circuit court must grant a removal of the disqualification if there is a finding by clear and convincing evidence that the petitioner will not be likely to act in a manner dangerous to public safety and that granting the removal is not contrary to the public interest. If a petition is granted, the county clerk must forward a copy of the order to the State Highway Patrol so the patrol can contact the Federal Bureau of Investigation for updating the petitioner's record with the National Instant Criminal Background Check System within 21 days of the receipt of the order. If a petition is denied, the individual may appeal, and the review of a circuit court ruling will be de novo.
A person can receive a concealed carry endorsement without meeting the current requirements if he or she submits a copy of a certificate of firearms safety training course completion that was issued on or before August 27, 2011, if it met the requirements that were in effect on the date it was issued.
Also passed was SB 489, which contains the following:

Under current law, a person commits a Class A misdemeanor if he or she possesses, manufactures, transports, repairs, or sells a switchblade knife. This act limits the prohibition to the possession, manufacture, transport, repair or sale of a switchblade knife when such uses violate federal law, and makes the crime a Class C felony.
Training requirements for concealed carry endorsement applicants were increased in HB 294 (2011). This act adopts a grandfather clause for those who were issued a firearms safety training certificate prior to the date the standards were increased, so these certificate-holders can receive a concealed carry endorsement without having to retake a training course.
This bill contains an emergency clause, which means it will go into effect the moment the Governor signs it.
HB 1319 and 1647 were sponsored by Representative Jeanie Riddle, and SB 489 was sponsored by Senator Brian Munzlinger.
HB 1647 was handled in the Senate by Senator Mike Kehoe and amended by Brian Munzlinger. In the House, SB 489 was handled by Representative Ward Franz.
Efforts by Senator Jim Lembke (to lower the number of shots to qualify for a ccw and a return to only one handgun) failed due to a complication of procedural and political dynamics.
There were no bad bills or provisions advanced before the end of Session.
