New OSHA rule creates concern for Employers'
drug and alcohol testing policies
OSHA's new drug testing and anti-retaliation rule, which alters the circumstances when drug testing can be conducted and reemphasizes the protections for employees to report injury and illnesses without fear of retaliation, is now in effect. The final rule, which has likely led to more calls to the labor law specialists at
Fisher & Phillips than any other change in recent years, contains key provisions of which employers should be aware.
Perhaps the most important provision of the new rule is that OSHA now believes that a blanket post-accident drug testing policy may be retaliatory and thus illegal. In other words, you may not be able to drug test an employee just because a workplace accident occurred. A related portion of the rule requires that an employer's internal procedures for reporting work-related injuries and illnesses must be reasonable and not deter or discourage employees from reporting. This includes giving employees several hours to report an injury or illness.
