Health Care Reform

DOL recalls decision to penalize employers who fail to provide
notice of healthcare coverage options by Oct. 1 deadline

  

You may have received notices regarding the Patient Protection and Affordable Care Act (PPACA) requirement to provide written notice to each of your employees regarding their health care coverage options. As yet another change to the constantly evolving Act, the Department of Labor (DOL) recently announced there will be no penalty imposed on employers who fail to distribute to workers a notice about available coverage under state- and federal-government-run health insurance exchanges (collectively referred to by the government as the "health insurance marketplace"), scheduled to launch in October 2013. Despite the DOL's decision to forego this previously mandatory requirement, the ACRA / Local Union 725 Health & Welfare Trust Fund Board of Trustees will meet next week to approve a model notices MCASF members may use to communicate to both their Local Union 725 member employees, as well as non-union office staff personnel. What is "Prevailing Wage"?

Contractors pursuing work on public projects should understand the concept of prevailing wage legislation. Simply put, prevailing wage (or "Davis-Bacon" as the laws are often referred to) is the hourly rate and fringe benefit contribution contractors are required by law to pay when working on federal or state construction projects. 

 

How is the Prevailing Wage determined?

The Prevailing Wage pay and benefit rate is set by the U.S. Department of Labor and is based upon responses to state Prevailing Wage / Davis Bacon wage surveys. Because our local wage rates were not carried when the last survey was performed in 2005, Davis Bacon wages in our area are roughly half of the R1 Journeymen rate. This means that a non-union contractor competing with our members for work on public projects is not required to match our current wage and benefit rates, which costs our members many job opportunities. When you factor in non-union associations' interest and efforts in keeping those rates low, you can see that it's very, very important for all of our contractors to participate in next year's survey.
