Updates on Existing Immigration Law & Policy Challenged by the Trump Administration:

I.    Employment Authorization for Certain H-4 Dependent Spouses (H-4 Rule)
  • DHS has indicated that in July 2018 they would provide through a 60-day notice and comment period, details concerning the cancellation of the H4 EAD regulation. In addition, there would be a 30-day period to reconcile those comments. After reconciliation they would publish a final rule with an effective date in the federal register.
  • At this time, the H4 EAD regulation remains in effect and MVP Law Group, P.A. has been successful in securing initial grants and renewal applications for H4 EAD recipients.
  • Qualified Applicants are encouraged to apply and/or renew their EAD, if they are eligible.
II.    TPS and Adjustment of States - Class Action
  • A class action lawsuit against officials at the U.S. Citizenship and Immigration Services (USCIS) and U.S. Department of Homeland Security (DHS) has been filed in a federal district court in New York, challenging the government's unlawful practice of depriving certain Temporary Protected Status (TPS) holders with close family relationships or employment in the United States from becoming lawful permanent residents. In particular, USCIS has a practice of denying the adjustment applications of TPS holders who, in accord with the Immigration and Nationality Act, have been "inspected and admitted" for purposes of adjustment of status because, prior to their receipt of TPS, they entered the United States without inspection (EWI).
  • Currently, USCIS applies its unlawful policy to TPS holders living everywhere in the country except for within the jurisdictions of the U.S. Courts of Appeals which have ruled on the issue, the Sixth, Ninth and Eleventh Circuits. Thus, the proposed class would include individuals living within the jurisdictions of the First, Second, Third, Fourth, Fifth, Seventh, Eighth, and Tenth Circuits.

May 15, 2018 - USCIS announced that data entry for all H1B CAP Subject Petitions under FY2019 had been completed
 
May 17, 2018 - Attorney General Jeff Sessions issued a decision in Matter of Castro-Tum , removing the authority/power of Immigration Judges to 'administratively close' deportation cases in the interest of fairness.  
May 18, 2018 - USCIS reminded F-1 Students on OPT that transferring to another school or beginning study at another educational level automatically terminates their OPT/EAD
 
May 22, 2018 - USCIS announced the re-registration period for TPS Beneficiaries of Nepal, beneficiaries must re-register between 05/22/2018 and 07/23/2018
 
May 25, 2018 - DHS proposed a rule to end the International Entrepreneur Rule
 
May 25, 2018 - DHS announced that an additional 15,000 H2B temporary nonagricultural visas will be available for FY2018
 
May 30, 2018 - USCIS announced the launch of their FOIA FIRST system that will allow users to submit, manage and receive FIOA requests entirely online

In other immigration news, the U.S. Department of State (DOS) Visa Bulletin for June 2018 is now available. The cutoff date movement is consistent with earlier predictions. The cutoff date for the EB2 category for India moved from 12/22/08 to 12/26/08 and EB3 remained at 5/1/08. The cutoff date for the EB2 category for Chinese Nationals remained at 9/1/14 and the cutoff date for the EB3 category for Chinese Nationals remained at 6/1/15.

USCIS to Recall Incorrectly Green Cards


On Monday, May 14, 2018, USCIS begin a recall of more than 8,500 Green Cards, officially known as Permanent Resident Cards due to a production error. The cards were printed with an incorrect "Resident Since" date. The cards in question were mailed out between February 2018 and April 2018.

 

USCIS has started sending out notices to affected clients, along with a pre-paid return envelope. USCIS would like them to return their incorrect Green Card in the pre-paid envelope within 20 days. JUNE 2018 VISA BULLETIN
The Department of State has released its latest Visa Bulletin.

The monthly Visa Bulletin has changed. The bulletin now summarizes the availability of immigrant numbers during the reported month for: "Application Final Action Dates" (consistent with prior Visa Bulletins) and "Dates for Filing Applications," indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center using Consular Processing (outside of the US) or file on their own with USCIS Form I-485 (within the US).
