It is extremely important that everyone is aware that the Trump Administration has initiated an attack on the undocumented population of the United States, as well as the LEGAL nonimmigrant/immigrant population over the last 18 months. Although no physical WALL has been constructed, slowly but surely, the Administration has created an invisible Wall severely restricting the legal immigration process.   
 
Over the past 18 months, the Trump Administration has enacted the following:

  • Policy against Executive Office for Immigration Review (EOIR) Continuances

In other immigration news, the U.S. Department of State (DOS) Visa Bulletin for August 2018 is now available. The cutoff date movement is consistent with earlier predictions. The cutoff date for the EB2 category for India remained at 3/15/09 and EB3 moved from 11/1/08 to 11/1/09. The cutoff date for the EB2 category for Chinese Nationals moved from 1/1/15 to 3/1/15 and the cutoff date for the EB3 category for Chinese Nationals moved from 1/1/13 to 7/1/14.

Supreme Court Upholds Trump Travel Ban

 

 

On Tuesday, June 26, 2018, the U.S. Supreme Court announced it had upheld President Trump's Travel Ban of mostly Muslim countries. The Supreme Court voted 5-4, with all five conservative Justices voting in the majority! The seven countries affected are: Venezuela, North Korea, Syria, Libya, Iran, Yemen and Somalia; the last five were on the original Travel Ban and are Muslim-Majority countries. The Travel Ban treats countries differently; Venezuela's Travel Ban is mostly against Venezuelan Government Officials traveling to the U.S. and the Travel Ban against Syria, travel is completely suspended. The Travel Ban was one of President Trump's major campaign promises!

AUGUST 2018 VISA BULLETIN
The Department of State has released its latest Visa Bulletin.

The monthly Visa Bulletin has changed. The bulletin now summarizes the availability of immigrant numbers during the reported month for: "Application Final Action Dates" (consistent with prior Visa Bulletins) and "Dates for Filing Applications," indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center using Consular Processing (outside of the US) or file on their own with USCIS Form I-485 (within the US).

Question #1 - Asylum
How does someone apply for Asylum status in the US?
 
Answer #1 -  If someone is eligible for Asylum or may think they are eligible for Asylum, they should speak with an Immigration Attorney immediately, as there is a time frame for applying for Asylum once arriving in the United States. If a person is eligible for Asylum, they apply directly with the USCIS by completing and submitting Form I-589, Application for Asylum and for Withholding of Removal, along with substantiating evidence to support their Asylum claim.
