Tom Mackie and Peter Durning recently wrote an editorial in Mass Lawyers Weekly discussing the prospects for the Permit Session Statute to fulfill its promise of facilitating large-scale development in the Commonwealth, as the Land Court's jurisdiction under the statute is headed before the Supreme Judicial Court.

Despite EPA's efforts to establish a clear definition for "Waters of the United States" with the issuance of the Clean Water Rule, there are numerous court challenges muddying the field.
Massachusetts continues to be in the forefront of embracing alternative energy initiatives.  The Renewables Corner goes around the horn on the status of implementing and growing the renewables footprint in the Commonwealth.
The firm is enjoying an impressive run of victories in a broad variety of settings, including MassDEP adjudicatory appeals, Land Court, the Appeals Court and pre-suit negotiations.
