Mozillo Criminal Investigation Closed

After paying a $22.5 million fine, and after Bank of America footed the bill for a $45 million settlement on his behalf, the Department of Justice has closed its criminal investigation of former Countrywide CEO Angelo Mozilo.

 

In October Mozillo settled a civil lawsuit with the Securities and Exchange Commission for $67.5 million, while not admitting or denying fault for his actions, which the SEC alleged helped bring about the financial meltdown.

 

The U.S. Justice Department closed the investigation of Mozilo that began in 2008, determining that those same actions made by Mozilo while he was CEO of the company were not criminal. But other investigations of Mozilo are still underway.

 

Last week Rep. Darrell Issa requested a subpoena be issued to Bank of America, which bought Countrywide in 2008, regarding the "Friends of Angelo" program that offered preferential loan terms to lawmakers and government officials, allegedly in exchange for political favors.

Caring for a Parent With Dementia

"Ashley, I know you're doing this because you love me. I'm sorry in advance for anything I might say later. You're making the right decision."  This was what my mother said to me during a moment of lucidity when she understood that her dementia was progressing, she had broken both of her hips and would be spending the rest of her life in a nursing home. Several seconds after saying this to me she asked me where she was and when she could go home. It was a brief absolution that most people never get and something for which I am profoundly grateful
  
It was that moment between my mother and I that I turned to when relatives challenged my decision to place her in a nursing home. It was that moment that I turned to when I doubted my own decisions and wondered how I could get 12k a month for around the clock in-home nursing care. I knew I was making the right decision, but it takes a concerted effort to stave off the guilt.
  
I  am not alone. Many of you are, or will be, caring for aging parents, some of whom have dementia in its various forms. There are several bits of practical advice I'd like to impart:

 

         Adjust your expectations. Remember it is you that must adapt, not your parent. Things are different now, and instead of being frustrated and angry, notice what s/he is capable of and adjust your expectations accordingly.

 

         Get long term care insurance- It would have been amazing for my family, but my mother had a stroke at 48, and at that young age she had not contemplated needing long term care. Contemplate it. Get it for yourself and your parents. Your children will thank you.

 

         Speak to an estate planning attorney to strategize how to preserve your, or your parents' retirement money if they need to self-pay for long term care. There are trusts available and ways to make Medicare work for you.

 

         Talk to other people who are going through the same thing. The following website has a list of online support groups for caregivers.  Dementia Website

 

         Ask for help! One person cannot do this alone, no matter your level of saintliness.

 

         Do not minimize your role or the effect it has on you whether your parent is in a nursing home, has home health care, or is living in your home. You are still a caregiver, and this advice applies to you! 

 

Doctors were unable to determine from my mom's PET scan what kind of dementia she has, and it doesn't really matter. I have learned to view my mother's dementia as a blessing. For a woman who was so active and social to be isolated and bedridden is sad. But for her, it is a brief hospital stay! She firmly believes she is going home any minute. This keeps her happy and hopeful, if not engaged and active.  As sad as it is for me to see my mom like this, and as much as I'd like to interact with her in a "normal" way-getting advice, sharing accomplishments and failures-it is comforting to know that she is not aware of the "tragedy" she is experiencing.  I am reminded of a moment of profundity from a Denny's waitress circa 2002 who worked at a nursing home part time. When I asked her how she could handle the sadness of working with people with dementia, she smiled and said she didn't think it was too sad, "God has a way of protecting his babies."

Woman Returns Dog

A British woman adopted a little Jack Russell only to return it complaining it clashed with her curtains. The woman had visited the English rescue kennel some 48 hours earlier to adopt the three year old Jack Russell named Harvey.

 

The un-named woman, in her late 40s, visited the kennel a number of times prior to adopting Harvey. In fact, she visited Harvey for seven days at the kennel before being allowed to take him home. However, upon taking Harvey home, the woman called to notify the kennel that she was having a problem with Harvey as his coloring clashed with her lounge curtains. The kennel staff suggested that she keep Harvey in another room.

 

Nonetheless, two days later, the woman returned Harvey to the kennel saying she did not want him anymore. She explained that she spent a lot of money on her curtains. Although the kennel staff said they have had many ridiculous reasons for returning a rescued dog (dog would not bark enough or was not cuddly enough), this was their most ridiculous reason by far for returning a pooch.

Additional Foreclosure Firms Investigated

 

The Florida Attorney General's Office has requested information from three additional law firms in connection with allegations of foreclosure fraud.  The Attorney General requested documents and information from Albertelli Law, Kahane & Associates and Law Offices of Daniel Consegura. 

 

Prior to this request, the Attorney General made the same request of Law Offices of David Stern, Shapiro & Fishman, Law Offices of Marshall C. Watson and Florida Default Law Group in connection with similar investigations. 

 

Many of bank and mortgage lender clients of David Stern's firm have terminated their relationship with the firm and sought replacement counsel amidst allegations of fraudulent document practices.

Bank of America Overdraft Class Action Settlement  

 

Bank of America has agreed to a $410 million settlement in nationwide class action lawsuits alleging that banks have abusive and excessive overdraft fee policies.

 

The suits, consolidated before U.S. District Court Judge James Lawrence King in Miami, sought to recover millions of dollars in fees charged to consumers on debit card purchases.

 

Last spring, Bank of America said it would stop charging those fees. Instead, customers could only make debit card purchases if they had enough money in their accounts. Other banks targeted in the lawsuit include Citibank, JPMorgan Chase, U.S. Bank, Wells Fargo and Wachovia, which merged with it.

 

The bank limits the number of overdraft fees a customer can receive to four a day from 10 a day. Bank of America also said it extended deposit cut-off times to 8 p.m. and reduced the length of deposit holds, which allows customers quicker access to deposited funds.
