The EB-5 Program

 

Congress created the EB-5 Program in 1990 to attract investors and entrepreneurs from around the globe to create jobs in America.   If an individual invests $500,000
in a "limited partner" capacity in an active enterprise with a U.S. Citizenship and Immigration Services ("USCIS") Regional Center designation that is located in a
Targeted Employment Area, and which will create indirectly at least 10 full-time jobs for U.S. citizens or permanent residents, the investor can receive permanent
residence for himself/herself and dependents. 
 
Miami Design District Investment Opportunity
 
The number of USCIS Regional Center designations continues to grow with investment opportunities located around the U.S.  Approved EB-5 petitions made
by Bander & Associates, P.A. clients have included many for investments in a USCIS Regional Center in Seattle, Washington and another for one in New York City, New York.  We are now pleased to be engaged to work on an EB-5 petition for an investment in the Miami Design District. 
 
This Miami Design District EB-5 opportunity is for Museum Village, a new Class A boutique office building that has received a USCIS pre-approval.  The investment site is located in the Miami Design District, an area that is quickly becoming home to luxury shops and restaurants founded by James Beard recognized chefs.  
 
Florida Overseas Investment Center (the "Regional Center") is the USCIS Regional Center for purposes of this investment and has been designated as a USCIS Regional Center since September 2009.  (Bander & Associates, P.A. has no corporate or personal relationship with Museum Village or the Florida Overseas Investment Center and is simply highlighting an investment that is in its community, as it will continue to highlight other EB-5 investment opportunities it believes may be of interest to its clients.)
 
The EB-5 Advantage
 
Permanent resident status based on EB-5 eligibility is available to the investor, her spouse, and unmarried children under 21 years of age. With permanent
residence through the EB-5 Program, the investor will obtain unrestricted work authorization for the investor and family members; can live anywhere in the United States indefinitely; and will be personally free of the responsibility of actively managing the investment or being employed by a sponsor.
 
EB-5 can be a life-saving option to individuals who have not had success in renewing L-1 visas, had immigrant visa petitions denied as a multinational manager

Update on H-1B Petitions for Fiscal Year 2013 

Substantial Number of Petitions for the FY 2013 H-1B Already Filed 

USCIS began processing first-time H-1B petitions for FY 2013 on April 1, 2012.  As of April 20th approximately 25,000 H-1B cap-subject petitions had been receipted, over one-third of the 65,000 visa cap.  USCIS had also receipted 10,900 H-1B petitions for aliens with advanced degrees, over half of the 20,000 visa exemption for such advanced degree holding individuals.  

 

U.S. businesses use the H-1B visa program to employ foreign workers in specialty occupations that require theoretical or technical expertise in the field such as scientists, engineers, architects, accountants, lawyers, or computer scientists.  Given the number of filings to date, it is clearly time for U.S. employers who would like foreign national professionals and skilled workers to start work on October 1, 2012 to submit their petitions before the cap is reached.
