LICENSE PLATE
  
In recognition of the importance of forestry in North Carolina and the state's status as the birthplace of professional forestry in the United States, the N.C. General Assembly has approved a special "First in Forestry" license plate. $20 of the $30 fee collected for each plate will go toward forestry education programs in the state.
 
The plates are available for purchase from the NC Division of Motor Vehicles online and at offices throughout the state.

Project Learning Tree (PLT) is an environmental education curriculum to help educators and natural resource professionals teach about the built and natural environments we live in and the resources we depend upon.
 
Nationally, PLT is a program of the American Forest Foundation, and is celebrating 30 years of programming in North Carolina through partnership with the North Carolina Cooperative Extension - Forestry, North Carolina Forestry Association, and the North Carolina Forest Service.

Shavender Fish Fry Attracts Crowd Annually 
Some 40 years ago, Buddy Shavender started his trucking company, and he thought it would be a nice gesture to sit down to lunch with the people he did business with in the forest products industry.  Simple enough.    

The lunch consisted of four people, Buddy Shavender of Shavender Trucking, John Underwood with Union Camp, Linwood Canady with Georgia-Pacific, and Bill Reid with Champion International.  

"I just thought it was an appropriate time to sit down and say thanks for doing business with me," stated Shavender.  

The next year the luncheon doubled in size to include  Barry Morgan and Johnny Gardener of S ummit Lumber and Charlie Wrightson and  Ken Burquise of Weyerhaeuser.  And so it began.  

Year after year, as Shavender Trucking increased its footprint in eastern North Carolina, so did the reputation of the annual Herring Fry.  

"I don't even want to try to count the miles we have covered since then," stated Shavender with a chuckle," but you can see here today from the crowd that it was a lot."  

Herring Fry 2017 attracted over 140 people!  Not so simple these days.  And judging by the smiles on everyone's face who enjoyed sampling outstanding food from the River's Edge Restaurant, it was another tremendous success.

In addition to saying Thank You to his friends in the forest products industry, Shavender also took the time to promote his upcoming Log A Load fundraising event, The 22nd Annual Colony Tire Sporting Clays Miracle Shoot, that benefits the Children's Miracle Network Hospitals. The event takes place on August 4-5, 2017 at the Rose Hill Farm (3881 Rose Hill Lane, Nashville, NC).  Registration is only a $65 donation and $35 for youth under 15.  There will be 50 rounds of sporting clays fun with several different Lewis Class competitions for men, women and youth.  A total of 27 guns will be awarded in all.   In addition, there will be a separate raffle drawing during the competitions for guns.

Reverse Raffle Ticket Leaders 
The Friends of Forestry PAC Reverse Raffle will take place after Forestry Day in the Legislature on May 2, 2017 at the Garden Inn Hilton in Raleigh, NC.  The drawing begins at 6:00 p.m. and is typically concluded by 9:30 p.m. as the final tickets are drawn.  

The winning jackpot is based on ticket sales and is generally $5,000.

General Assembly Update 
The NCFA continues to engage in the legislative process on a day-to-day basis at the North Carolina General Assembly.  Here are a few highlights from the past week.  

House Bill 142 was passed by both chambers and signed by the Governor on March 30, 2017.  The bill reduced the amount of state boards. The NCFA opposed this bill early on when the State Board of Registration for Foresters did not make the initial list.  The NCFA supported the bill once it included the Registration for Foresters Board. 

House Bill 80 has not made any headway in its current form.  The NCFA is monitoring this bill closely and is still opposed to it in its current form.  

The NCFA supports and prefers the newly introduced  Senate Bill 532 - Landowner Encroachment and Timber Theft Act - that  seeks to  provide resources, authority, and guidance to the North  Carolina Forest Service law enforcement section to monitor  and reduce losses due to landowner encroachment, timber, and   other natural resource theft or loss and to increase the  penalties associated with these crimes.   

The NCFA also supports House Bill 467 - Agriculture and Forestry Nuisance Remedies (partner bill is Senate Bill 460) that seeks to clarity the remedies available in private nuisance as it pertains to agriculture and forestry.   

Another positive bill is House Bill 525 - Operating Funds for Linville Nursery (partner bill is Senate Bill 341) is supported by the NCFA.  This bill would appropriate operating funds for the North Carolina Forest Service's Linville River Tree Nursery.

President's New Executive Order Seeks to Promote Energy Independence  
President Trump recently signed an executive order, entitled Promoting Energy Independence and Economic Growth.   The Executive Order  (Click here for a copy)  requires all federal agencies to identify all rules or policies that could burden domestic energy development and submit a plan to revise them within 180 days. 

It requires EPA to review and likely rescind the Clean Power Plan and related rules and the Interior Department to do the same with energy rules related to federal land. 

Finally, it rescinds various policies affecting energy development, including the Climate Action Plan and those related to the social cost of greenhouse gases. (March 28, 2017)
 
Points of Interest:
1.  While the review of rules burdensome to domestic energy development directs "particular attention" to oil, natural gas, coal and nuclear, it provides an overall policy statement in the first section of the EO recognizing the importance of these energy sources plus "other domestic sources, including renewable sources."

2. Directs the EPA to review the Clean Power Plan and the new source greenhouse gas rules for consistency with the EO and take appropriate action to suspend, revise or rescind the rules. The EPA has sent a notice for publication to the Federal Register initiating the review of the Clean Power Plan.

3.  Directs the EPA to similarly review the proposed model trading rules and revise or withdraw them.

4.   Authorizes the Attorney General, after being informed by the EPA of any action taken under the above directions, to request appropriate action by the court pending completion of the action by the EPA. The Attorney General has asked the U.S. Court of Appeals for the DC Circuit to suspend the challenges to the Clean Power Plan until the EPA completes its review and any subsequent rulemaking.

5.  Revokes the Presidential Memorandum of November 3, 2015 ("Mitigating Impacts on Natural Resources from Development and Encouraging Related Private Investment").

6.  Directs the Council on Environmental Quality (CEQ) to rescind the "Final Guidance for Federal Departments and Agencies on Consideration of Greenhouse Gas Emissions and the Effects of Climate Change in National Environmental Policy Act Reviews."

7.  Directs all agencies to identify and take appropriate steps to suspend, revise or rescind any policies or rules related to or arising from the above Presidential actions. The Secretary of the Interior has revoked a 2013 Secretarial Order on mitigation and directed Interior agencies such as the Fish and Wildlife Service to review all policies related to the EO and take appropriate action.

Forestry Day and Reverse Raffle 
May 2, 2017  
The NCFA's Forestry Day in the Legislature will take place on Tuesday, May 2, 2017 on the Halifax Mall in Raleigh.  Forestry Day is a great opportunity for NCFA members to reach out to their elected officials about the important role forests and the forest products industry.  

Registration materials will be mailed next week - please check your mailbox for the form or click here to download a fax/email version to return to the NCFA office.  

The Friends of Forestry Political Action Committee will once again be conducting a reverse raffle this year.  Tickets will be distributed to FFPAC members and NCFA Board Members at the NCFA's Board Meeting in February. 

The raffle, which is the FFPAC's top fundraising event, will take place on the evening of Forestry Day at the Hilton Garden Inn Raleigh Crabtree, which is located on 3912 Arrow Drive, Raleigh, NC.   This year promises to be the best raffle night in recent years!  In addition to heavy appetizers and beverages, there will be a special door prize raffle for those in attendance.

ProLogger Base Class Schedule
The NCFA will be hosting three offerings of the ProLogger Base Course in 2017.  The base course is a two-day program that is mandatory for all professional loggers who would like to earn ProLogger status.

Toney Lumber Company is seeking a Sawmill Forman/Millwright. Duties include maintenance, welding and all types of general repair and is  responsible for daily production, quality control, safety and managing the daily operation of a sawmill and 18 to 25 employees.

Legislation  

The NCFA staff continues to monitor the activities of the North Carolina General Assembly.  The following are some of the bills the NCFA is monitoring closely at this point.  The bills in their current form can be found by clicking on the titles.

House Bill 3 - Eminent Domain (partner bill is Senate Bill 34)
This Eminent Domain Bill seeks to protect landowners and provide more options in the case where property is taken via eminent domain.  The bill passed the House.  It passed its first reading in the House and is currently referred to the Committee on Rules and Operations within the Senate.  The NCFA supports this bill at this point.

House Bill 10 - Eminent Domain Statutory Revisions (partner bill is Senate Bill 35) This Eminent Domain Statutory Revisions Bill provides updates to existing public good projects to include natural gas and communications equipment.  The bill passed its first reading and has been referred to the Committee on Health.  The NCFA supports this bill at this point.

This bill amends the process set forth currently in the payment of disputed legal fees by the industrial commission.  This bill has passed the House.  It passed its first reading in the Senate and has been referred to the Committee on Rules and Operations of the Senate.  The NCFA is neutral on this bill at this point.

House Bill 56 is a generic bill that addresses that an owner of a high-hazard or an intermediate-hazard dam shall develop an Emergency Action Plan that includes the involvement of a professional engineer or person under the responsible charge of a professional engineer to ensure it protects public safety and welfare.  This bill passed its first reading.  It has been referred to the Committee on the Environment.  The NCFA is neutral on this bill at this point.  It's worth noting that this bill could include more provisions moving forward. 

House Bill 80 - Bona Fide Ownership of Timber Parcels
This bill seeks to protect forest landowners from timber being unlawfully cut and/or removed from their property by mandating that the forest landowner obtain a survey of his/her property that clearly defines the property lines of his/her property.  This bill has passed its first reading and has been referred to the committee on Judiciary III.   This bill has not moved since the second week of February.  The NCFA does not support this bill in its current form and continues to work with bill sponsors to amend it so it maintains private property rights without imposing an unnecessary financial burden on the landowner. 

This bill seeks to adjust the weighting attributed under the transportation investment strategy formula to the department of transportation's division engineers, the metropolitan planning organizations, and the rural transportation planning organizations, when selecting regional impact and division need projects, as recommended by the house select committee on strategic transportation planning and long term funding solutions.  The bill seeks to allow more input from local communities within the current priority system employed by the state for infrastructure projects within the state. This bill has passed the House.  It has passed its first reading in the Senate and is now in the Committee On Rules and Operations.  The NCFA supports this bill at this point and will continue to monitor its progress.  

This bill would authorize permitted oversized or overweight vehicles to travel after sunset when transporting and delivering cargo, containers, or other equipment to or from international ports.  This bill has passed the House and has been sent to the Senate.  It passed its first reading in the Senate and has been referred to the Committee on Rules and Operations of the Senate.  The NCFA supports this bill.  

House Bill 142 - Increase Oversight of Occupational License Boards
This bill seeks to increase oversight and streamline existing licencing boards in the state.  The State Board of Registration for Foresters is currently listed as one of the 58 boards that will remain active.  This is a positive change from the previous versions of this bill introduced in the last legislative session.  This bill passed the House and Senate.  It was signed by the Governor on March 30, 2017.  The NCFA supported this bill after it included keeping the State Board of Registration for Foresters.  Session Law 2017-4

House Bill 168 - Study Damage from ATV Use
This bill would authorize a study the damage caused to various types of properties from unauthorized use of all-terrain vehicles.  The bill has passed its first reading in the House and has been referred to the Committee on Transportation.  The NCFA supports this bill.   

This bill to change the property tax exclusion for solar energy by lowering the percentage from eighty percent to sixty percent of the appraised value of a solar energy electric system.  The bill passed its first reading and is now in the Committee on Energy and Public Utilities.  The NCFA is neutral on this bill at this point.   

This bill would prohibit hunting from the right-of-ways of public roads in Buncombe County.  It has passed its first reading in the House and been referred to the Committee on Rules, Calendar and Operations.  The NCFA is neutral on this bill at this point.  

This bill would permit fox and coyote trapping in Yadkin County.  The bill passed its first reading and has been referred to the Wildlife Resources Committee.  The NCFA is neutral on this bill at this point.

House Bill 309 - Responsible Deer Management Act
This bill imposes a duty to avoid wanton waste on persons taking wildlife under a depredation permit.  This bill has passed its first reading and has been referred to the Committee on Agriculture.  The NCFA supports this bill at this time but will continue to monitor its progress.

This bill would provide provisions to protect bee populations.  This bill has passed its first reading and has been referred to the Committee on Rules, Calendar and Operations of the House.  The NCFA supports this bill.  

This bill would establish the North Carolina Joint Legislative Task Force
on regulatory reform.  This bill has passed the House and sent to the Senate.  It passed its first reading and has been referred to the Committee on Rules and Operations of the Senate.  The NCFA supports this bill.  

House Bill 454 - Surveying and Plat Recording Changes
 (partner bill is Senate Bill 372)  
This bill seeks to modernize and make changes to the recording requirements for plats and subdivisions and to eliminate the use of control corners in favor of grid control in the preparation of plats and subdivisions.  This bill passed its first reading and has been referred to the Committee on Regulatory Reform.  The NCFA is neutral on this bill at this time.  

House Bill 465 - A Military Operations Protection Act of 2017 
(partner bill is 
Senate Bill 331)  
This bill would impose a temporary moratorium on the consideration of permit applications and issuance of permits for the construction of new onshore and offshore wind energy facilities direct a study of geospatial, temporal and other data to understand the extent and scope of military operation in this state.  This bill has been filed.  The NCFA supports this bill.  

House Bill 467 - Agriculture and Forestry Nuisance Remedies (partner bill is Senate Bill 460)  This bill seeks to clarity the remedies available in private nuisance as it pertains to agriculture and forestry.  This bill has passed its second reading. The NCFA supports this bill.

House Bill 525 - Operating Funds for Linville Nursery (partner bill is Senate Bill 341)   This bill would appropriate operating funds for teh North Carolina Forest Service's Linville River Tree Nursery. This bill passed its first reading.  The NCFA supports this bill. 

House Bill 648 - Responsible Deer Hunting - This bill seeks to provided responsible hunting of deer with dogs in a manner that protects the rights of private landowners.  This bill has been filed.  
  
This bill seeks to make changes act to revise the assessment of certain civil penalties by the department of public safety.  The bill includes a local option for appeals in cases such as motor vehicle and/or trucking violations.  This bill passed its first reading and has been referred to Judiciary.  If it passes that committee, it will be referred to Rules and Operations of the Senate.  The NCFA supports this bill. 

Senate Bill 76  - Permit Nightime Hunting of Coyotes
This bill directs the Wildlife Resources Commission to repeal its regulation banning night hunting of coyotes in certain coastal counties. This bill has passed its first reading and is being referred to the Committee on Rules and Operations within the Senate.  The NCFA is neutral on this bill at this point.

This bill  amends certain environmental, natural resources, and  other laws. Bill passed the Senate and has been sent to the House.  The bill passed the House after several amendments.   The newest version is linked in the title. It has been sent back to the Senate.  The NCFA is neutral on this bill at this point.  

This bill seeks to establish a uniform procedure to determine title to oil, gas, or mineral rights.  It has passed its first reading and has been referred to the Committee on Rules and Operations of the Senate.  

This bill would create a coyote tagging and bounty program in Richmond County.  This bill passed its first reading and has been referred to the Agriculture/Environmental/Natural Resources Committee.  The NCFA is neutral at this point on this bill.  

This bill imposes a temporary moratorium on the consideration of  permit applications and issuance of permits for the   construction of new onshore and offshore wind energy  facilities and direct a study of geospatial, temporal, and other  data to understand the extent and scope of military operations  in this state with respect to energy infrastructure.  This bill has passed its firest reading and has been referred to the Committee on Rules and Operations fo the Senate.  The NCFA is neutral on this bill at this time. 

This bill seeks to make various changes and clarifications to the statues governing the creation and enforcement of building codes.  This bill has passed its first reading and has been referred to the Committee on Rules and Operations of the Senate.  The NCFA is neutral on this bill at this time. 

This bill provides resources, authority, and guidance to the North Carolina Forest Service law enforcement section to monitor and reduce losses due to landowner encroachment, timber, and  other natural resource theft or loss and to increase the penalties associated with these crimes.  This bill has passed its first reading.  The NCFA supports this bill.
