Curry Wants to Censure Me


We should Get Back to City Business!

I hear this from many of my constituents, but my fellow councilman, Keith Curry, is continuing to push the issue that I brought up of SAME SEX MARRIAGE. Evidently, 2 hours of hearing back on July 14 wasn't enough. Curry has requested that I be censured at this Tuesday's council meeting because of my support of Traditional Marriage.

I NEED YOUR HELP ONCE AGAIN

  • mail the council at [email protected] (the entire council will get your email) and let them know what you think.
  • Attend the council meeting at 7pm this Tuesday and speak and let them know what you think.

Why Censure?
  1. Because I believe that same sex marriage is wrong.
  2. Many of the current city council used the city seal, either as a councilperson or candidate, in their own communications. The difference is that I used it while stating my beliefs opposing same sex marriage.

WHAT HAPPENED at the LAST MEETING?
 
4 weeks ago now, I wrote in my email (see it here) that I disagreed with the Supreme Court decision to a constitutional right to same sex marriage. 
 
SPECIAL (REGULARLY SCHEDULED) MEETING
 
The Mayor called for a special meeting over the top of our regularly scheduled meeting with only one agenda item on it to pass a resolution  that called me out for using the City Seal on my email newsletters, and specifying that no council member would be allowed in the future to put anything out that purported to be from the entire council without the council approval as determined by the majority of the council. 

By having this special meeting it allowed the LGBTQ crowd to speak on an agendized item and allowed the city council to talk about it as well.

TWO HOURS OF TESTIMONY

So after 2 hours of public testimony, where over 35 LGBTQ supporters came out and talked about how I offended them, with some calling for my resignation, the council passed the resolution 4-3. 

About 25 people there supported me; five of these spoke. I thank you all for doing that; I much appreciated seeing some friendly faces in the audience.

I also greatly appreciated how my colleagues, councilmen Duffy and Kevin Muldoon, both stood by me through the ordeal. Their strong character was on display and I thank them.

WE SHOULD GO BACK TO CITY BUSINESS

Since that meeting and until this Censure action, the furor had died down. There had been no press requests. No Media whatsoever. 

I believe Curry is trying to make political hay, either because he is trying to divert attention from the City Hall Audit that is in process, or he is apparently still bitter about his embarrassing defeat in his 2014 California State Assembly race against now Assemblyman Matt Harper, or our clean sweep of his preferred Newport Beach council slate, or the voter's repudiation of the past council's misuse of taxpayer dollars.

 
Much Ado About Nothing


 
The City Seal is Gone

Much has been said of my alleged misuse of the city seal. These are allegations by political adversaries who are trying to drive a wedge between me and my colleagues, city staff, or constituents. The city ordinance on the use of the seal is very ambiguous, but a reasonable reading would allow that any council member has the right to use the seal at any time for any reason in their capacity as an elected official.

For example, your congressman might write you a newsletter on his letterhead, including an image of the seal of the US Congress to show him as a member. No one would interpret the content of his newsletter as representing the entire US Congress. It would reasonably be interpreted as the position of only that particular congressman.

IT WASN'T THE SEAL

Furthermore, I did not use the official city seal. I used a photo of the seal on the wall of the council chambers, with the flags in the foreground, with 2 other photos in the background of my email banner, from my campaign email account, with a disclaimer that says the email was paid for by my campaign.

RED HERRING

Therefore, it seems to me that Curry and my opponents are using my use of an image of the Seal as a convenient surrogate for what really upsets them, and what is the real issue - my opposition to Same Sex Marriage.  And that is the bait-and-switch they seem to be using to achieve a Censure vote against me: not because I mis-used the image of the seal, which I maintain I did not, but because they disagree with my sincerely held religious views against same-sex marriage (as I explained at the July 14 meeting).

But I have removed images of the Seal from my e-mails.  So all this could be behind us, and we could move ahead with the business of the City.  Except that some would rather disingenuously flog an artificially created whipping boy for their own political gain.
