The 571 - L (personal Property Tax forms) are due on May 7. Upon receipt, please forward the form directly to your GL specialist, if you have not already done so. Despite the 5/7 due date, we require lead time in order to properly complete and review the filing prior to submission. 
 
If you have not yet received the Form 571-L, please contact your County Assessor's office to obtain the form for us to complete or the information necessary for us to complete the filing electronically. Note that failure to have a Form 571-L filed by 5/7 will result in a 10% penalty which will be added to your personal property tax bill.   
 
San Francisco business renewals are due on May 31. All invoices should have been received by this point. Please be sure to include those invoices in your weekly package.

 Golden Road Brewery
California is no stranger to the abundance of wine-centric venues it proudly offers up. However, when it comes to wine's counterpart, beer, the golden state has some catching up to do; that's where Golden Road Brewery comes into play. Located in the Glendale neighborhood of Los Angeles, owners Tony Yanow and Meg Gill have opened the largest craft brewery LA has ever known. "The inspiration was simple," proports Gill. "Tony and I had a passion for building a world-class local brewery and LA happened to be the biggest market in the country with such a void." 
 
Tony, of Tony's Darts Away and Mohawk Bend, is certainly no stranger to conceptualizing successful restaurants in and around Los Angeles and Meg who comes by way of Oskar Blues Brewery, knows her way around microbreweries. Together, this dynamic duo has concocted the perfect blend of good food, great beer, and a wonderfully fun and engaging environment. "The goal for our restaurant is to create 'Golden Road lifers' out of our customers" Gill explains.
 
Golden Road Brewery features three distinctly different selections of beer from which to choose; Anytime Beers, Custom IPA's, and Limited Releases. The Anytime Beers are simply great for everyday and appeal to most palates. The Custom IPA's utilize seasonal variatials and have very distinct flavors all their own. Lastly, the Limited Releases follow neither seasonal nor specific flavor sensibilities. Conversely, the Limited Releases are solely based on the specific direction of Brewmaster, Jon Carpenter, and that with which inspires him. These are crafted into smaller brews and are available on a short-term basis. 
 
The menu at Golden Road Brewery has been specifically contrived to harmonize their current beer selections and bring special consideration to the pairing of the two. Executive Chef Adam Levoe conceptualizes GRB's cuisine based on all things local, fresh, and seasonal. The diverse and ever-fluctuating menu features an impressive assortment of snacks, hearty salads, hot and cold sandwiches, and entrees which appeal to both vegetarians and carnivores alike. They also offer several desserts-if that is, you still have the room. 
 
In addition to all things beer, Yanow and Gill are also very passionate about lessening their carbon footprint and their commitment to sustainability and eco-sensibility. This is exemplified in the packaging of their beers which they've chosen to feature only aluminum cans. As the duo states, "It's better for the beer, better for the environment, and better for taking beer where glass just can't go." They also feature an assortment of 20 revolving beers on tap at all times. 
 
While Golden Road Brewery has instantly become a favorite neighborhood hot-spot, they too, have received a multitude of accolades ranging from LA Weekly's top 10 Beer Bars in Los Angeles to receiving the title of Whole Foods "Most Successful Local Beer Launch." While Tony and Meg are excited about the positive press they've received, their ultimate goal still remains; strive to expand people's enjoyment of their time at the pub, continue to be creative in their development of diverse beer selections, and focus on being as sustainable a business as possible.

Meal and Rest Break Summary of Changes, April 2012

 

Breaks and Meal Periods: A summary of the Brinker Restaurant Corp. v. Superior Court

The California Supreme Court released its long awaited decision in Brinker Restaurant Corp. v. Superior Court.

The most critical part of the decision is that employers do not have to ensure employees take their meal breaks; however they do need to provide a meal break for employees. What does "provide" mean? According to the court, the employer satisfies its legal obligation to provide an off duty meal period to its employees if it:

  • Relieves its employees of all duty
  • Relinquishes control over their activities
  • Permits them a reasonable opportunity to take an uninterrupted 30-minute break
  • Does not impede or discourage them from doing so

The duty to provide a meal break is an affirmative duty on the part of the employer that must meet the above requirements; it is more than simply making the meal breaks available. The court emphasized that, once the employer has satisfied the above test, "the employer is not obligated to police meal breaks and ensure no work thereafter is performed." The employer is to relinquish control over the employee's time, including whether the employee chooses to work during the meal period.

Importantly, if an employee continues to work after the employer satisfied its obligation of providing a duty-free meal period, the employer is not liable for premium pay.

Meal Period Timing:

The Court holds the relevant Labor Code provision and Wage Order only requires an employer to provide a first meal period no later than by the end of any employee's fifth hour of work and a second meal period no later than by the end of an employee's tenth hour of work.

Rest Break Clarification:

The Court determined that this means employees are entitled to a ten minute rest break for shifts between three and one-half to six hours in length, two ten minute rest breaks for shifts of more than six hours up to ten hours, three ten minutes rest breaks for shifts of more than ten hours up to fourteen hours, and so forth.

Based on the Brinker decision, California employers should:

  1. Ensure your policy manual outlines the employees' meal and rest break rights in accordance with the law
  2. Ensure all employees are aware of their meal and rest break rights by having a signed receipt and acknowledgment of your policy manual
  3. Authorize employees to take an uninterrupted 30-minute meal break if they work more than 5 hours
  4. Authorize a second meal break if they work more than 10 hours
  5. Ensure time records show meal breaks started no later than five hours (4:59:59) after an employee's shift begins
  6. Ensure time record show when meal breaks end (and pay employees for all their work time)
  7. Authorize employees to take a 10-minute rest break (one for each four-hour work period or "major fraction")
             * one rest break for shifts of 3-1/2 to 6 hours
             * two rest breaks for shifts of 6 to 10 hours
             * three rest breaks for shifts of 10 to 14 hours
      
      8.  Schedule rest breaks in the middle of each four-hour work
             period (if practical)
      9.  Do NOT coerce, create incentives for, or otherwise
          encourage employees to skip their breaks 

 

Note:

"Employers have an obligation both to relieve their employees for at least one meal period for shifts over five hours and to record having done so. If an employer's records show no meal period for a given shift over five hours, a rebuttable presumption arises that the employee was not relieved of duty and no meal period was provided."
