WASHINGTON (AP) – Aug. 3, 2017 – Long-term U.S. mortgage rates were little changed this week after declining for two straight weeks.

Mortgage buyer Freddie Mac said Thursday the rate on 30-year, fixed-rate mortgages inched up to 3.93 percent from 3.92 percent last week. While historically low, that's still above last year's average of 3.65 percent. The benchmark rate stood at 3.43 percent a year ago.

The rate on 15-year, fixed-rate home loans, popular with homeowners who are refinancing their mortgages, slipped to 3.18 percent from 3.20 percent last week.

Mortgage rates haven't risen substantially despite the Federal Reserve having increased its key interest rate four times in the past 18 months. The Fed said last week that it's keeping the rate unchanged at a time when inflation remains undesirably low despite the job market continuing to strengthen.

FAQ regarding marketing rules:

Q:  I'm a broker, ordering business cards for my sales associates. What is required to be on licensees' business cards? 

A:  The business card is a form of advertising. Thus, the information on the business cards must comply with 61J2-10.025(1) and (2), Florida Administrative Code. The business card must include the licensed name of the brokerage firm, and if the licensee’s personal name is used, at the very least that person’s last name must appear as it is registered with the Florida Real Estate Commission. The card may not include any fraudulent, false, deceptive or misleading information, and it must make clear to reasonable persons that they are dealing with a real estate licensee. 

Q:   Must I display my brokerage company’s information on my website?
 
A:  The advertising rules of Section 61J2-10.025(3)(a), Florida Administrative Code, require that Internet ads display the brokerage company’s licensed name above, below or adjacent to the brokerage or individual licensee’s point of contact information. The Code further defines point of contact information as mailing and/or physical addresses, email addresses, and telephone or fax numbers.

Q:  May a mortgage banker and a real estate broker advertise their services together, for example, on the same brochure or newspaper advertisement? 

A:  Nothing in RESPA prevents joint advertising. However, each party should pay pro rata share of the cost to avoid a RESPA violation. 

FREC considers rules for team advertising
 

July 17, 2017 – Concerns are rising regarding misleading advertising by real estate teams.

As a result, the Florida Real Estate Commission (FREC) held an exploratory rule workshop last year to discuss the issue. That resulted in a plan announced earlier this summer to hold a rules workshop. Its goal: To propose new rules that regulate team advertising.

Florida is not the only state considering rules regarding team advertising. So far, over a dozen states have adopted team advertising rules.

Florida Realtors supports FREC's rulemaking effort. New rules could, among other things:

  • Require a real estate team advertisement to display or include the name of the licensed brokerage firm in a size equal to or greater than the size of the team name.
  • Limit the use of certain terms in advertising by teams. Those limited terms would include words such as "realty" and other similar ones that could lead a consumer to believe that they're dealing with a brokerage rather than a group of sales associates.
