Section 504 and IDEA Comparison

 

As a parent, you are your child's greatest advocate, supporter, and cheerleader. By becoming knowledgeable regarding educational laws as well as services and programs available within your community, you can ensure that your child receives a Free and Appropriate Public Education (FAPE). There are two primary laws that cover your child's rights to a public education:

  • Individuals with Disability Education Improvement Act (IDEA)
  • Section 504 of the Rehabilitation Act of 1973
Understanding how Section 504 and IDEA work with and complement each other allows you as the parent to better assist your child's educational team to ensure your child's right to a Free and Appropriate Education (FAPE) is provided allowing for maximum educational success.

Medical Home Portal 

The Medical Home Portal is a source of specialized information for physicians, parents, teachers, and other professionals to help them care for and and about children and youth with special health care needs (CYSHCN) and to collaborate on their behalf. The Portal is unique in offering information for both families and professionals (particularly Medical Home teams) and in providing information about relevant local services. 

Frequently Asked Question

"How do I get special education services for my child?"

  1. Referral or request is made for an evaluation.
    Parents/Education Advocates/Guardians may request an evaluation, it is recommended that this request in is made in writing. Parental consent is needed before the child may be evaluated. Evaluation needs to be completed within a reasonable time upon parental consent.
  2. Child is evaluated. The evaluation assesses the child in all areas related to the child's suspected disability. The evaluation results will be used to decide the child's eligibility for special education and related services and to make decisions about an appropriate educational program for the child. If the parents disagree with the results, they have the right to seek an Independent Educational Evaluation (IEE). They can ask that the school system pay for this IEE.
  3. Eligibility is decided. A group of qualified professionals and the parents look at the child's evaluation results. Together, they decide if the child is a "child with a disability," as defined by IDEA. Parents may ask for a hearing to challenge the eligibility decision.
