Greetings!

To avoid first going to the Rules Committees, Senate bills must be introduced by February 5th, and House bills must be introduced by February 9th. As expected, there was a massive increase in the number of bills yesterday afternoon. We are now tracking 62 gun bills and 23 hunting bills.

A mini gun bill day is scheduled in the Senate Judicial Proceedings Committee (JPR) on Tuesday, February 13th at 1:00 PM. See the bill list below and contact the Committee members to voice your support or opposition as appropriate.

The Daily Record reported that the Maryland Capitol Police dropped all charges against the 2A activists who were arrested last Monday for exercising their 1st Amendment right to peacefully and lawfully defend the 2nd Amendment on public property.

The Civilian Marksmanship Program (CMP) will soon be selling approximately 8,000 Army surplus Colt 1911 .45 ACP semi-automatic pistols. See the article below for details.

Senate Gun Bill Hearings - Tuesday, February 13, 2018 @ 1:00 PM

SB 0448  
To add and include antique arms and/or replicas to the list of "firearms" a person who is prohibited from owning firearms may no longer own or possess. This bill was prompted by a domestically related homicide in which the perpetrator used a black powder pistol. Antique firearms and replicas of antique firearms are not federally regulated and thus a NICS check cannot be done. While antiques and replicas may be confiscated by law enforcement; there is no means for a dealer to identify a person who is prohibited, and thus no means to prevent a subsequent purchase. (crossfiled with HB 0402)  OPPOSE

Altering the time period in which a permit to wear, carry, or transport a handgun expires from the current 2 years, to 5 years after the issuance; and altering the time period for renewal of a permit to wear, carry, or transport a handgun from the current 3 years, to 5 years after the last renewal.  SUPPORT

For persons eligible for relief under a civil protective order under § 4–504.1, § 4–505, § 4–506, and under the protection of an order as defined in § 4–508.1 of the Family Law Article, or a petitioner under a current peace order entered under Title 3, Subtitle 15 of the Courts Article. Requires the Secretary of the Maryland State Police to waive the initial training requirement for a permit to wear and carry a handgun provided the person successfully completes the training with 30 days of receiving the permit. Also, requires that the permit be issued within 10 days of the date of application.   SUPPORT

SB 0602  
Providing that a person may not be denied the right to purchase, possess, or carry a firearm solely on the basis that the person is authorized to use medical cannabis. Bill a ppears to be in conflict with existing federal firearms law which lists marijuana use as a disqualifier.  No Position

Would authorize certain law enforcement agencies which sought the forfeiture of a firearm to then sell, transfer or exchange the firearm to a federally licensed firearms dealer. This bill applies only to law enforcement agencies in Garrett, Allegany, Washington, Frederick and Carroll counties. (crossfiled with HB 724)  SUPPORT

UPDATE: Democrat's Gun Control Agenda

Ban on Bump Stocks

SB 74 Criminal Law - Firearms Crimes - Bump Stock, a pre-filed bill, was withdrawn by Senator Ramirez just over two weeks ago. This now dead bill focused on so-called "bump stocks" and referred to other parts which could increase the rate of fire of an "assault weapon" as defined by Maryland law.

Unfortunately, the Ramirez bill has been replaced by SB 707 and HB 888 - Criminal Law – Firearm Crimes – Rapid Fire Trigger Activator. These crossfiled bills contain far more onerous language that appears intended to ban not only "bump stocks" and "trigger cranks," but also competition triggers. Possession of any device or parts which are designed to increase the rate of fire above the standard rate of fire would constitute a violation. The term "standard rate of fire" is undefined.

It is not clear whether this ban will apply to the enumerated list of "assault weapons" or all firearms. What is clear; is that this bill bans the possession of such devices, no grandfathering provision is included and a violation for simple possession is a misdemeanor punishable upon conviction imprisonment not exceeding 3 years, or a fine not exceeding $5,000, or both.

SB 707 Criminal Law – Firearm Crimes – Rapid Fire Trigger Activator , is scheduled for a hearing in the Senate Judicial Proceedings Committee (JPR) on Wednesday, February 28th at 1:00 PM.

HB 888 Criminal Law – Firearm Crimes – Rapid Fire Trigger Activator, is currently on First Reader the House Judiciary Committee (JUD). Watch for updates on this bill.

Elimination of Handgun Permit Review Board

SB 741 and HB 819 - Public Safety - Handgun Permit Review Board - Repeal
Crossfiled bills which would eliminate the Maryland Handgun Permit Review Board (HPRB), a citizen oversight board which has served effectively for over four decades. Carry permit appeals would be heard by an administrative law judge at the Office of Administrative Hearings, which is a government agency.

SB 741 Handgun Permit Review Board - Repeal , is scheduled for a hearing in the Senate Judicial Proceedings Committee (JPR) on Thursday, February 22nd at 1:00 PM.

HB 819 Handgun Permit Review Board - Repeal , is currently on First Reader in the House Judiciary Committee (JUD). Watch for updates on this bill.

Definition of Transfer

SB 860 and HB 1031 - Public Safety - Regulated Firearms - Transfer
Crossfiled bills which define transfer as anything other than a gratuitous exchange in which the individuals involved remain at the same location.

And Now Something Different - A message From the CMP
From a CMP Email Dated January 29, 2018:


Status of the CMP 1911s, 1/29/2018:
 
The CMP has been authorized to receive 8,000 1911 type pistols from the United States Army.
 
The 1911s have been received by the CMP. A complete inventory will be conducted over the course of this week. The pistols will then be securely stored until the Army-approved 1911 building and armory infrastructure is completed. That completion is anticipated to be approximately 60 days from now. Once the 1911 armory is completed, inspection, grading, repair, and ultimately test firing of the pistols will begin. (Please be aware that the CMP was led to believe that we were ready to move forward, but three weeks ago facility requirements were changed, and we are now fulfilling those requirements.)
 
The CMP 1911 order packet will be posted 90 days prior to the order acceptance date and opening sales date. No orders will be accepted prior to that date. Please visit  www.thecmp.org , click on the Sales icon then 1911 Information, for the latest. CMP customer service has been inundated with calls and emails concerning the 1911s and no further information is available at this time.
 
The CMP will keep everyone posted as we move through this process.
