Premises Liability
New Jersey - Hudson County Superior Court

Cause of injury:
Plaintiff alleged injury due to negligent security by the hotel and the security company. Defendants denied liability maintaining that there was no duty to protect the plaintiff from criminal acts of third parties, that the security provided was adequate, that the incident was not foreseeable and that in the event there was negligence, there was no proximate cause between any negligence and the injury. In addition, the defendants argued that the unidentified perpetrator was responsible. The hotel settled shortly before trial.

Nature of injury: 
facial lacerations and scarring, tooth injury

Judge:
Hon. Joseph A. Turula

Result:
After a week long trial a jury of 5 women and 1 man returned a defense verdict, finding that the Shafer Glazer client was not negligent.

Transportation Liability

New York - Supreme Court, New York County

Cause of injury:
Plaintiff alleged that while crossing 34th Street between 5th and 6th Avenues outside of the crosswalk, she was hit in the head by the side view mirror of a New York Transit Authority bus. Plaintiff alleged that the bus had a duty to avoid contact with a pedestrian even though the contact occurred outside of the crosswalk. Defendant asserted that it had the right of way, that it drove is a normal manner and that the plaintiff failed to protect herself by either keeping an eye out for the bus or hustling across the 4 lane road when she jaywalked.

Nature of injury: 
Traumatic Brain Injury with permanent cognitive deficits and post-traumatic depression

Judge:
Hon. Shlomo Hagler

Result:
After a 2 ½ week trial, a jury of 4 women and 2 men returned a defense verdict, finding that the Shafer Glazer client was not negligent.
