ABA Section of International Law Teleconference on Vodafone and Beyond: Changes to India's Tax Regime for Structuring a Transaction

Recent retrospective amendments to India's tax code (although characterized as "clarifications"), contained in the latest union budget, the Finance Bill, 2012, will tax indirect transfer in respect of gains derived from offshore transactions where substantial value is attributable to underlying Indian assets and interests. This clarification has been proposed in response to the recent decision of the Supreme Court of India in the Vodafone case. This teleconference of the American Bar Association's Section of International Law (India Committee) will update participants on these proposed changes that have been causing confusion and doubt amongst investors into India.
