I've heard living wills are not recognized in Massachusetts; if so, how do I express my medical wishes (advance care directive)?
I am buying a house. What are the benefits of having a Real Estate Attorney represent me personally if the Lender is also "providing" an Attorney?

As Spring flowers bloom and the grass finally begins to grow, the Massachusetts legal community has put into effect new laws in the areas of Divorce and Probate Law. Last time we shared with you information on the changes in alimony law; this month we highlight the new rules and forms involving wills/probate/guardianship.
In addition to these two major changes of law, this newsletter will hit on questions in the practice areas of real estate and elder law, and offer a solution to help you with those difficult decisions you may need to make for your elderly loved one.
Remember, we encourage you to send any of these notable "tidbits" to friends, relatives or anyone you think may find this information helpful and informative. Suggest to them that they JOIN OUR NEWSLETTE R EMAILING LIST by clicking below.
Enjoy the great weather we are having. No shoveling required!! Thank you, Allan and Amy Beth Baron |

New Probate Law in Massachusetts
We are officially in the early days of the implementation of the new probate law in Massachusetts. Sweeping changes to the probate law include the updating of terminology, changes in the intestacy order of distribution (if you die without a will),and changes to how people may probate estates in a more streamlined and less supervisory way. Moreover, the probate law changes also include different ways and procedures involved for the appointment of guardians and conservators. The intention behind the changes to Massachusetts Probate Law is to bring our Probate Court System into the 21st century and unify its forms and procedures with that of most other states. This is a great time to find and look over your legal estate documents, meet with us to discuss and review your documents and determine whether the new laws necessitate changes be made, as you wish, to your estate planning documents. Set up your estate review meeting today. |

Something to Think About...
A question relevant to so many people in this day and age: Is your elder parent reaching that crucial time when he/she needs to leave home? If so, there are so many options for that next step- an Independent Senior Living Facility, Traditional Assisted Living Facility, Memory Impaired Unit or Nursing Home- that your head can spin with decisions about what is best.
You don't have to research and consider those options alone. Amy Beth Baron is an Attorney, Trained Mediator, and Registered Nurse with Specialty Certifications in Life Care Planning and Medical Case Management. She will work with you as a Legal Nurse Advocate and Negotiator to find the accommodation for your elderly loved one that is the best fit for them as individuals and at the best financial value while providing optimal care and safety.
Your elderly loved one will also likely need help with legal decision drafting documents, which may include advanced care directives, durable powers of attorney, and guardianship or conservatorship appointments along with the facility lease/contract that will need to be executed prior to moving into their new home.
Our next letter will talk more about how Amy can assist you when your elderly loved one needs to transition from their home into a safe, supervised, quality driven facility that still promotes their independence. If you have questions in the meantime, contact Amy today. |
