Commercial Property Due Diligence: 

Storm Water BMP

Building inspections, appraisals, and surveys quickly come to most buyers' mind when they are conducting due diligence on a commercial property purchase. One "under the radar" issue that commercial buyers should be aware of is storm water BMP facilities. A storm water BMP refers to a Best Management Practice (BMP) for handling the discharge of storm water runoff from a commercial property or a residential subdivision. These BMP's reduce the amount of nutrients and pollutants leaving the property and ultimately ending up in our drinking water.

Storm water BMP's vary from simple grassy areas to very sophisticated underground systems. The government regulations dealing with this issue also vary greatly depending on the county in which you are located. Some storm water BMP's have an Operations  & Maintenance handbook recorded with the property deed. The responsibility of operating and maintaining the BMP is transferred to new ownership as a result of a real estate transaction.
