What Constitutes a Breach of the Peace When Repossessing a Vehicle?

We have received several questions recently through our Compliance Consultation Service from dealers who have found a person or animal inside of a vehicle they were trying to repossess. Under Texas law, lienholders are allowed to repossess a vehicle as long as they don't create a "breach of the peace." In this video, TIADA's Amber Hackett Crosby explains what a breach of the peace is and what options dealers have if they find themselves in these situations.

Remember These Guidelines to Stay Safe at Auctions

Most dealers have attended so many auctions in their careers they could not even count them. However, this familiarity can lead some to be less mindful of their surroundings and lead to dangerous consequences.  It is easy to be distracted by the buzz of activity that happens during an auction and forget or ignore safety guidelines.

Recently we spoke with Rich Levene of ADESA Austin regarding auction safety. He explained keeping dealers safe is one of their top priorities for each and every auction. Part of keeping people safe is working to remind them of safety guidelines that too often are either forgotten or ignored. In this blog post, we share some of the guidelines that Levene emphasized will help ensure dealers always return home safe.

3 More Reports Question CFPB's Actions and Structure

Recent projects completed by the Competitive Enterprise Institute and the Cato Institute again delved into unsatisfactory assessments of the Consumer Financial Protection Bureau. Coinciding with House Republicans chastising the CFPB over its investigation of Wells Fargo, a wide-sweeping survey conducted by the Cato Institute found that participants agree with an assertion previously made by the Consumer Bankers Association - that the bureau should be run by a commission rather than a single director.

Task Force Busting Fake License Plates Forced to Shut Down

It's a massive problem in North Texas and it's driving by you everyday: fake paper license plates. Consumer Justice Investigator Cristin Severance found out the task force dedicated to catching those crooks is being forced to shut down. It's called the Dallas County Clean Air Task Force - a misleading name for a group whose mission is to get fake paper tags off the road. The task force is made up of four traffic enforcement deputies and ten detectives. They say 90% percent of the paper plates on the roads are fake. The plates are mainly used to hide either the vehicle or the driver from the law. "And it's not just a certain part of the county," said Deputy Jerry Cox, "It's the whole North Texas area."

California Considers Its Own Ban on Combustion-Engine Cars

The internal combustion engine's days could be numbered in California, where officials are mulling whether a ban on sales of polluting autos is needed to achieve long-term targets for cleaner air. Gov. Jerry Brown has expressed an interest in barring the sale of vehicles powered by internal-combustion engines, Mary Nichols, chairman of the California Air Resources Board, said in an interview Friday at Bloomberg headquarters in New York. Brown, one of the most outspoken elected official in the U.S. about the need for policies to combat climate change, would be replicating similar moves by China, France and the U.K.

Volvo Just Launched a New Subscription Service for Its Cars - But It's a Bad Deal for Consumers

Volvo is rolling out a new alternative to traditional car buying or leasing, called Care by Volvo. It's essentially an elaborate rental arrangement, eliminating loan/leasing down payments and insurance requirements while adding a suite of concierge services. Volvo described it as a "premium subscription" and will offer it when a new compact crossover SUV, the XC40, hits the market. The vehicle was unveiled on Thursday in Italy.
