Simply stated, done right, employee handbooks provide employers with an important shield to defend against (or possibly avoid) employment claims, including claims accusing the employer of discrimination, harassment, overtime violations or breach of contract. But done wrong, employee handbooks can be used as a sword by opportunistic plaintiff's employment lawyers to take advantage of clumsy, inaccurate or unlawful language in a handbook. It is critical that employers review their handbook every year to ensure that the policies in their handbook keep up with their actual business practices and constantly changing employment laws.
