Dennis McAndrews talks Title IX this week on WFMZ-TV Channel 69 News
Dennis McAndrews, Founder and Managing Partner of McAndrews Law Offices, P.C., was interviewed and featured this week on WFMZ-TV Channel 69 News in Berks County in regard to a federal lawsuit filed this week in Philadelphia. Parents of a Boyertown Area Senior High School student are suing the District after the student (referred to as Joel Doe) had multiple instances when changing in the school locker room with a transgender student. Doe was told by school officials to "tolerate" their transgender-friendly policy. The family claims this policy "constitutes sexual harassment and is a violation of personal privacy."
 
While McAndrews is not involved in the case, WFMZ spoke with him for his expert opinion on this matter being that he has over 30 years of experience in education law and discrimination cases. Because Title IX is an exceptionally sensitive and controversial issue with schools today, it is more likely than not that the courts will struggle with these matters for the next several years.
 
McAndrews explains: "School districts are in a very difficult decision because you have two administrations who have issued very different either policy interpretations or policy statements with regard to Title IX" and while "Both are protected by Title IX, it's a question of 'Whose rights trump the others?', or 'Is there an accommodation that is permissible to allow them both to change in the same room?' "
 
McAndrews concluded with, "Just like Title IX is up for grabs, what it really means is the right to privacy in Pennsylvania with regard to gender is a new ballgame."
