THE DO's AND DON'Ts OF UNEMPLOYMENT HEARINGS

Do: - Respond on time
- Read the hearing notice in its entirety - make sure to take notice of deadlines to submit pertinent documentation
- If the hearing is in person - bring 3 copies of ALL documentation to provide to hearing officer, claimant and for yourself (just in case it is needed)
- Bring written policies, acknowledgment of such policies and any warnings if applicable prior to the termination
- If key witnesses are applicable to the case, make sure they are available or postpone the hearing if possible
- Focus on the act that resulted in termination rather than allowing the claimant to highlight his positive performance reviews in past years, etc.
- Only provide the necessary evidence - do not have several witnesses present the same testimony
- Have closing argument - summarize the reason for termination, awareness of company policy and any other reasons why the unemployment should not be awarded
Don't:
- Assume the benefits will be denied just because of discharge
- Miss the hearing or be late
- Attend the hearing unprepared
- Fail to show what employer did to attempt to preserve the employment
- Fail to contradict the claimants theory of separation
- Fail to present first hand testimony
