  • New CFTC forex rules went into effect on Oct. 18 for RFED accounts. Foreign banks have extra 270-days to comply. Has there been any fall-out so far?

  • Financial-transaction tax (FTT) seems very unlikely in the EU and North America. But some leaders in Germany are still pushing for an EU-wide FTT, in spite of EU-leadership shooting down their proposals several times. Hot-emerging market Brazil just drastically-increased it's FTT in an attempt to slow down hot money inflows to limit the appreciation of its currency. A similar FTT toll-charge would be inappropriate for the U.S., because the U.S. does not have a hot money problem and a toll charge would inappropriate for the dollar which is the largest reserve currency in the world.

  • Dodd-Frank Fin Reg changes. There are still unintended consequences unfolding. As I wrote during debate of this bill, bank profits would suffer significantly from the loss of trading and alternative investments. Some banks cut out prop trading already, well before the Volcker Rule's effective date, perhaps to reduce year-end FDIC assessments on their balance sheets and systemic risks (per Dodd-Frank). Trader jobs have been cut on Wall Street and that hurts the NYS/C budgets too. We offer a home to bank traders in our Traders Association and we can help you establish your own trading business, prop trading firm, and/or investment management business. Will Republicans gain enough new seats in Congress to mount a challenge to Dodd-Frank Fin Reg?

  • Investment management business. France and the UK finally agree on the new EU-wide hedge fund and private equity rules. Per Reuters on 10/19,"Britain prevails as France's Lagarde backs down. Start of EU-wide license for foreign funds delayed." It appears that U.S. hedge fund managers and private equity firms dodged a bullet on much tougher EU-passport/registration rules, which could have significantly restricted their access to EU investors. Thanks to Treasury Secretary Geithner for being very firm with France on this matter. As banks downsize alternative investment businesses, and the markets continue a bullish run, independent hedge funds are growing nicely again. Investment managers should not forget to comply with stricter registration, compliance, and other rules enacted in Dodd-Frank Fin Reg too.

  • Entities and retirement plans. There is still sufficient time in 2010 to form your own trading entity and related retirement plan to save more taxes this year.
