Understanding the Civil Damages of DUI
Individuals who recklessly drive their vehicle while under the strong influence of alcohol or drugs has increasingly become a huge problem for innocent pedestrians and other innocent drivers, whose very life and safety can be put at risk. 
 
CT law, of course specifically prohibits this conduct both from a criminal perspective and from the civil standpoint. 
 
On the criminal side  these "drunk drivers" as they are often called can serve jail time and lose their license for a period of time for their dangerous behavior. 
 
On the civil side , when these drunk drivers harm other innocent motorists or pedestrians, there are three main CT statues that apply, which prohibit this conduct and can expose the drunk driver, and in many case their insurance company, to a verdict at trial for not only regular money damages, but also double and treble damages and punitive damages for their wrongful conduct in violation of these CT safety traffic laws.  



Medicare and Personal Liability Settlements

 

Did you know that if Medicare pays medical bills related to your personal injury matter they must be repaid out of your settlement.  We have a lot of experience handling these Medicare liens as they are called. We ensure that the bills Medicare paid are in fact related to your case. If they are not related, we have Medicare remove them from the claimed lien. Second, we make sure that the at fault insurance company provides us ample compensation as part of the settlement of your case to cover these accident related medical bills that Medicare paid so the lien can be repaid. Finally, we submit a form to Medicare with the settlement amount, costs of litigation, attorney's fees, outstanding medical bills, and then Medicare reduces the amount of the lien that has to be repaid applying credits for these costs just listed.
