How many hours does the employee need to work with a company before they offer medical insurance?
 

The ACA requirement to offer health coverage is for full-time employees. The ACA generally defines a full-time employee as one who at the start date is reasonably expected to work 30 hours/week or more.  Thus the overall application is if an employee on their start date is expected to work 30 or more hours/week then they are a full-time employee unless they fit the variable hour, seasonal or part-time definition.  Health coverage must begin no later than the 90th calendar day of employment. Employers must have a minimum of 50 employees.

Can an employee be required to perform work outside of the employee's job description?


Yes. The Fair Labor Standards Act (FLSA) does not limit the types of work employees age 18 and older may be required to perform. However, there are restrictions on what work employees under the age of 18 can do. This is true whether or not the work asked of the employee is listed in the employee's job description. 

 


How does a business get the credit for the state unemployment taxes?


The computation of the credit for state unemployment taxes that were paid by your business is made when you complete Form 940, Employer's Annual Federal Unemployment (FUTA) Tax Return. The instructions for Form 940 provide detailed guidance as well as a worksheet that takes you through the computation step-by-step. Must I pay unused vacation pay to an employee who quits?  


The wage and hour laws do not require that an employer provide vacation pay (private sector) but if promised and earned, it is due and payable. So whether or not vacation pay is due depends on your policies and how they are written and implemented.
