David C. Prather Obtains Settlement 10x More than Policy Limits for Client Injured in High-Speed Crash

Our client was driving along highway I-95 on her way home when she was suddenly and unexpectedly involved in a high-speed crash. The defendant driver was racing down the interstate at over 100 mph and lost control of his vehicle, striking our client from behind and causing her vehicle to spin into a nearby lane. 


The defendant then crashed into a third vehicle before coming to a stop. Despite the fact that the defendant driver was reckless in his driving, his insurance company failed to tender his policy limits upon our firm’s request and denied liability for the accident.

Notably, the defendant driver’s insurance company failed to interview a key witness to the accident who confirmed the defendant’s reckless and egregious conduct and advised that our client was not at fault for the accident.


In spite of the clear and uncontroverted negligence, as well as the eyewitness’ statement confirming what happened, the defendant driver’s insurance company failed to timely tender their policy limits. Thereafter, firm partner, David C. Prather, filed a lawsuit and rejected the subsequent tender of the driver’s policy limits.


Within 30-days of filing the lawsuit, the defendant’s insurance company agreed to pay 10x the defendant driver’s policy limits for the accident in order to avoid a potential trial and bad faith action due to their insured’s blatant negligence and his insurance company’s failure to timely tender his policy limits.
