SB 440 (Ochoa Bogh) - Creates a timeline and process for change order claims on private works construction projects. Requires general contractors to submit subcontractor claims. Authorizes prevailing party attorney fees and 2% monthly penalties on undisputed payments owed related to change orders.
SB 464 (Smallwood-Cuevas) - Expands the application of an existing law to include businesses that employ “construction and extraction” occupations to annually report the race, ethnicity, sex, pay data and other similar information to the California Civil Rights Department. Excludes employers with less than 100 employees.
SB 61 (Cortese) - Caps the amount of retention to 5% for private works construction.
SB 809 (Durazo) - Authorizes the voluntary Construction Trucking Employer Amnesty Program where, generally, an eligible contractor is relieved of liability and penalties if, among a host of requirements, the contractor agrees to properly classify all drivers as employees. The program is open for a limited time. Also authorizes reimbursement for the use of a truck, tractor or trailer through a two-check system.
AB 289 (Haney) - Authorizes the development of a “speed safety system,” which includes automated radar and laser systems, along highway construction work zones that cite motorists with a civil penalty for exceeding the speed limit.
AB 390 (Wilson) - Clarifies the “move over law” for motorists approaching emergency vehicles on state highways applies to Caltrans contractors.
AB 538 (Berman) - Authorizes a local agency to request certified payroll records from a contractor if it is not in possession of them. Requires the contractor to submit the records within 10 days.
SB 597 (Cortese) - Makes general contractors, on private works construction projects, liable to a labor trust fund for any indebtedness for the performance of labor incurred by a subcontractor including, under certain conditions, penalties and liquidated damages. Contains a variety of statutory corrections.
AB 978 (Hoover) - Eliminates the sunset date, thereby making it indefinite, for the requirement that local agencies use recycled materials in streets and highways.
SB 779 (Archuleta) - Increases CSLB penalties for unlicensed activity. Also authorizes the board to increase existing penalties based on the Consumer Price Index.
