AUTO THEFT BILLS PASS

Without your help this would not have happened. Your calls, emails, and testimony convinced enough legislators to vote yes on SB23-097, which makes auto theft, no matter the value, a felony. They also passed SB23-257, which funds five million dollars to the Colorado State Patrol, Task Forces, and Attorney General offices. Both bills will enable law enforcement to fight auto theft, but as owners we still need to protect our dealerships by taking the needed steps to deter the thieves.


TRAINING TO IMPROVE YOUR BOTTOM LINE

I have attended multiple conferences and every one of them stresses training to improve your bottom line. When was the last time you trained your employees on YOUR way of conducting business at YOUR dealership? When you ask successful business people how they achieved success, it almost always is their employees and the culture that owners instill at the workplace. Do your employees understand your policies and processes? Do they know how you want them to handle your disgruntled customers? We must not forget happy and unhappy customers belong to you. As the owner of the business, how you handle them sets the tone for your employees.

COLORADO DRIVES ALERT

DR 2395 Application for Title and/or Registration and KCW Clarification

There have recently been concerns raised about the requirement to complete the opt-in/out portion of the DR 2395. This section is an optional field for title-only transactions submitted by dealers and other stakeholders when they are not completing the registration process or opting in/out for the customer.


Additionally, per SB21-249, customers must choose to opt-out of the KCW pass if they do not wish to purchase it; thus, the form should not be rejected for registration transactions either, as the customer is automatically opted-in per the bill. Thus, the DR 2395 should not be rejected if the below section is not completed.

California Titles

Please be advised that California titles were further discussed in the April 26 Requirements, Clarification and Improvement (RC&I) meeting after feedback was received from counties. During this meeting, the following was voted and agreed upon:

  • On the front of a California title, the Signature of the Registered Owner(s) needs to be executed and dated.
  • On the front of the title, the registered owner(s) and the buyer need to acknowledge the odometer and sign and print their name(s) or agent’s full name along with a company name if the vehicle is registered under a Company name and ensure that it is properly dated. (REG 262 Stamped or written in is not acceptable)
  • On the top of the back of the Title - Application for Transfer by New Owner - this is where the final buyer information will go, regardless if they are a California resident or not, since the title has no other spot for buyer information.
  • The bottom of the back of the California title is for title reassignments by licensed California dealers only. If the vehicle is sold to an out-of-state dealer (i.e. a Colorado dealer), the reassignment area can be used. The DR 2407 will also be allowed for additional assignments to include when the back of the California title is full.

·        Reg 262 will continue to not be allowed for reassignments/odometer disclosures; it may be used as a POA per Bulletin 16-2 California Vehicle/Vessel Transfer and Reassignment Form REG 262. 

 

The above process for California Titles will be effective April 28, 2023.
