Compliance Announcements

Letter from our Broker Dave Springer

7/12/24

    Hi All,

I wanted to take a moment to mention a few compliance items to help us all lower our liability.

I made a video a few days ago that was posted in our private FB group. If you do not belong to the group, I would encourage you to be a part of it. There is a lot of good information that is shared there and a lot of engagement from our agents. This video was about the seller's disclosure form.

SELLER'S DISCLOSURE FORM

It is very important that your sellers fill this out completely. Every line should have a check for yes, no, unk or N/A. An example would be #9 - Water Supply. If it is public water, they should check that box "yes" and each of the following boxes for "no". Even if your seller is an investor and has never lived in the property, they must fill it out fully. If a seller does not know the answer, they can check "unk". It is a liability issue for all parties involved, when they are not filled out fully. The same goes for when you have a buyer. If the seller has not filled it out fully, you should be requesting that to be done.

PAPERLESS PIPELINE

Please make sure that when you are uploading your docs to Paperless Pipeline, you are doing so per our policy within 5 days of execution of an agreement of sale or listing. All required docs should be uploaded at that time. Make sure that they are fully filled out, iinitialed and signed where needed. Enter all information in the fields in the transaction such as names, list price, sale price, commission (to SRG), etc. Use Paperless Pipeline as your hub for all information about a transaction. Upload any documents that relate to the transaction, even if not on the checklist (inspection reports, change in terms, etc). Forward important emails to the transaction. It is great to have one spot that you can go to if you ever need to and be able to access everything related to a transaction.

ADVERTISING/MARKETING

Make sure that you are being compliant anywhere you are marketing yourself. This includes email signatures. Please check your signature. I get frequent emails internally and externally from agents that sign their name, maybe the company name and their cell phone number. In any of your sales interactions and marketing, the company name, your name, the company phone number and your phone number should be listed. Your information can not be larger than the company information. This is not an SRG policy. This is a Real Estate Commission policy and I do not want to see anyone get fined for non compliance.

CONSUMER NOTICE/BUYER AGENCY AGREEMENTS

If you have not already, please begin getting your buyer agency agreements signed prior to showing houses. This will be a requirement very shortly, so get a jump start. If a buyer is not comfortable signing it, you can let them know that this is now a requirement. You can always sign it specific to a single property or for a one day term if they have an issue. The consumer notice has always been required to be signed early on in the process. I would like everyone to create a transaction in Paperless Pipeline where you can store these forms prior to having a property under contract. You can create a transaction called Consumer Notice/Buyer Agency Agreements (Your Name). PP only allows one transaction name, so they can't all be named the same way, so if you add your name after it, that will work around that issue.

I understand that these things can be a headache or annoying, but again, I am trying to protect all of us from liability issues and these are a few ways to help. If you have any questions, feel free to reach out anytime.

Thanks and have a great weekend.

Dave Springer

All Agents

Create a transaction in Paperless Pipeline

Transaction Name: Consumer Notice/Buyer Agency Agreements (+ your name)

Status: Consumer Notice/Buyer Agency Agreements File

Label: Consumer Notice/Buyer Agency Agreements

Please see the image below for an example.

Why is this needed?

The brokerage is required to have all the Consumer Notices on file

for any client that has been helped by our agents,

regardless if an actual transaction is completed.

Agents are required to have all their Buyer Agent Agreements

on file for anyone they showed a house to,

regardless if an actual transaction is completed.

Please keep all of your Consumer Notices

& Buyer Agency Agreements

together in this one file.

New Disclosure Forms in Paperless Pipeline

We are pleased to announce our new disclosure forms for Buyers & Sellers.

These replace our prior disclosures.

Please find them in the reference section of Paperless Pipeline.

For Buyers, we have a document called "SRG Buyer Forms". In the footer, you will notice it is labeled Form B-1 v0724.

This document combines the BUYER TRANSACTION DISCLOSURES, RELEASES, AND AUTHORIZATIONS document, the WIRE FRAUD ADVISORY FOR BUYERS, and the HOME INSPECTION DISCLOSURE into one document vs three.

For Sellers, we have a document called "SRG Seller Forms". In the footer, you will notice it is labeled Form S-1 v0724.

This document combines the SELLER TRANSACTION DISCLOSURES, RELEASES, AND AUTHORIZATIONS document, and the WIRE FRAUD ADVISORY FOR SELLERS into one document vs two.

We hope this helps to streamline your paperwork process a little bit.

PS: We are in the process of updating our checklists to reflect

the required Bright MLS form, & updated PAR forms.
