39th Annual MLK Jr. Day of Celebration
Members of the MBA team attended the 39th annual MLK Day Celebration Luncheon at the Lansing Center on Monday to listen to the inspiring words of civil rights icon Ruby Bridges. Ms. Bridges, known for being the first black child to integrate Louisiana Schools at the age of 6, was featured speaker.
This celebration is among the largest for Martin Luther King, Jr. Day nationwide, and tickets for the event sold out months in advance, drawing over 1,500 attendees.
The theme for this year's event centered around compassion, embodying the spirit of the legendary civil rights leader Martin Luther King, Jr.

Two $750 scholarships to Emerging Leaders in Michigan to attend the 2024 Emerging Leaders Forum on March 18 in Washington D.C. are available. The $750 can be used for travel and/or lodging expenses and is reimbursed by the ABA after the conference. CFPB Proposes to Apply Reg Z to Overdraft Protection at Large, Midsize Banks
The CFPB proposed to apply the requirements of Regulations Z to overdraft fees at banks and credit unions with more than $10 billion in assets. The proposal would also require banks to calculate and disclose an annual percentage rate on each overdraft fee.
The CFPB noted that overdraft fees have, since the passage of the Truth in Lending Act in the 1960s, been excepted from Reg Z’s definition of finance charges. Under this proposal, Regulation Z would apply to overdraft protection services provided by banks and credit unions with assets over $10 billion, unless the overdraft services are “provided at or below costs and losses as a true courtesy to consumers.” The proposal envisions two ways of determining cost: allowing covered institutions to calculate their own costs and losses using the bureau’s proposed standards, or by relying on a benchmark fee set by the bureau. (The CFPB asked for comment on $3, $6, $7 or $14 as proposed benchmarks.)
The bureau also proposed to amend Regulation E to prohibit compulsory use of preauthorized electronic fund transfers for repayment of transactions paid into overdraft by institutions covered by the proposal that charge overdraft fees above a certain threshold.
While the proposal does not cover financial institutions with assets of $10 billion or less, the bureau warned that it “plans to monitor the market’s response to this rule before determining whether to alter the regulatory framework for financial institutions with assets less than or equal to $10 billion.”
The MBA will aggregate concerns from member banks on this issue. Comments on the proposed rule are due April 1. Read the rule.

Letter to Regulators on Basel III Implementation
The MBA along with other state bank trade associations, signed onto a letter to the regulatory agencies sharing our concerns for the Basel III Capital Proposal. Among the concerns, in addition to bank operational risk are restriction of funds for residential mortgages, capital projects and credit for small and mid-sized business. Please find the letter here.

Gov. Whitmer to Deliver 2024 State of the State Address on January 24
Governor Gretchen Whitmer will deliver her sixth State of the State Address on Wednesday, January 24 at 7:00PM. The address will be held in the Michigan House Chambers in front of a joint session of the Michigan House of Representatives and the Michigan Senate and broadcast live throughout the state.

Hsu to Speak at Conference for Community Bankers
Acting Comptroller of the Currency Michael Hsu will speak at the 2024 Conference for Community Bankers, Feb. 11-13 in San Antonio, Texas. Hsu has led the OCC since May 2021 and also serves on the FDIC board and the Financial Stability Oversight Council. He will join ABA President and CEO Rob Nichols to discuss current banking policy issues and the OCC’s 2024 top priorities. Register. Michigan bankers attending will enjoy dinner together on Monday, February 12.
