Clark Fountain Partner Ben J. Whitman secured a $20,000,000.00 partial settlement in a complex wrongful death matter.
The settlements reached to date involved claims for motor vehicle negligence including insurance bad faith against the automotive insurance carriers, professional negligence regarding design, engineering, and construction of a commercial premises, and multiple product liability and defect claims related to failed safety equipment.
Due to the terms of the settlements, the names of the parties are confidential, but the settlements reached to date compensate the family for their pain and suffering and allow them to proceed against the many remaining parties to the litigation.
Reflecting on the case so far, Whitman expressed gratitude for the strength of the family in the wake of the tragedy and his hope that the litigation will force the companies involved to improve their safety practices.
