"Because of this case, people who go to prison at a young age, like I did, should now get the education and extra support they deserve. "
Adam X. (a pseudonym), plaintiff
Three students filed a class-action case stating that they had been denied special education services when they were in prison. The students were joined by two organizations: The American Civil Liberties Union of NJ and The Arc of NJ.
The settlement class includes anyone who:
- Was in NJ Department of Correction (NJDOC) prison after January 11, 2015 and was age 20 or younger during any of their time in prison
- Received special education services before they went to prison; has an educational disability or may have had an educational disability in school before going to prison.
The settlement includes:
- New NJDOC policies regarding special education
- Five years of monitoring
- A compensatory education program
Both people who are still in prison and those who have been released who think they are eligible and want to receive compensatory services should apply. An independent expert determines whether each person is eligible for compensatory services.
